HomeMy WebLinkAboutCD-03-002 - Church of God/Prince of Peace 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 4O 41 42 43 44 45 CD-03-002 MNSP-02-017 AN ORDER GRANTING APPROVAL FOR A MINOR SITE PLAN TO BE KNOWN AS CHL RCH OF GOD/PRINCE OF PEACE WHEREAS, the St. Lucie County Community Development Director has reviewed the application for site plan approval submittec by Stephen Cooper, P.E. & Associates, Inc., reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: Church of God/Prince of Peace is a proposed 12,000 square foot religious facility for 5 59 acres of property located on the west side of Oleander Avenue, approximately 100 feet south of Ulrich Road in the RF (Religious Facilities) Zcning District. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. The project s consistent with the general purpose, goals, objectives, and standards o the St. Lucie County Comprehensive Plan and the St. Lucie County Lanc Development Code. 4. The project wile not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable d strict regulations. 7. The project is to be served by adequate public facilities and services. The applicant has applied for and received an updated certificate of capacity, a copy of w~ich is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. File No.: MNSP-02-007 January 27, 2003 CD Order 03-002 Page 1 1 2 3 4 A. 5 6 7 8 9 10 tl 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 3O 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 NOW, THEREFORE, BE IT ORDERED: Pursuant to Section 11.02.03 (D) of the St. Lucie County Land Development Code, the proposed minor site plan to be known as Church of God/Prince of Peace, is hereby approved as shown on the site plan drawings for the project prepared by Stephen Cooper, P.E. & Associates, Inc., September 10, 2002, and received by the St. Lucie County Community Develol:ment Director on September 10, 2002, on the property described as follows: THE EAST t/2 OF THE FOLLOWING DESCRIBED PROPERTY: BEGIN IN THE SOUTHWEST CORNER OF LOT 220; THENCE RUN NORTH 63 FEET; THENCE RUN EASTERLY TO A POINT ON THE EAST LINE OF LOT 220, WHICH IS 52 FEET NORTH OF SAID LOT'S SOUTHEAST CORNER; THENCE RUN SOUTH TO THE SOUTHEAST CORNER OF SAID LOT; THENCE RUN WEST ON THE SOUTH LINE OF SAID LOT 220, TO A POINT OF BEGINNING; LESS THE EAST 33 FEET FOR ROAD. SAME BEING THE SUBDIVISION OF SECTION 9, TOWNSHIP 36 SOUTH, RANGE 40 EAST, AND THE NORTH '/2 OF TI- E SOUTH t/2 OF THE SOUTHEAST 1/4 OF THE NORTHEAST 1/4, LESS THE EAST 33 FEET FOR ROAD PURPOSES, SECTION 9, TOWNSHIP 36 SOUTH, RANGE 40 EAST. (TAX ID. #: 3409-143-0001-000/1) (Location: 5905 Oleander Avenue. West side of Oleander Avenue, approximately 100 feet south of Ulrich Road.) The approval periods described in Administrative Order CD-03-002 shall remain in full force and effect. The approvals granted by this administrative order shall expire on January 27, 2005, unless an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. The Final Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioners, Church of God/Prince of Peace, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to; the United States Arm~, Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed 3n file with the St. Lucie County Community Development Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. If this order expires or otherwise terminates, the certificate of capacity shall automatically terminate. F. This order shall be recorded in the Public Records of St. Lucie County.
