Schwan's Sales En\erprises. Inc., presented a petition for a Minor Site Plan approval to construct a 7,007square foot industrial building to be known as Schwan's Distribution Facili-:y, in the IL (Industrial, Light) Zoning District for the property described in Part B and generally located on Block A, Lots 21 and 22, Kings Highway Industriall'ark (Ft. Pierce). 2. The site plan for th~ proposed project has been reviewed and found to meet the minimum technical requirements of the Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 3. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development Code. 4. The proposed proje ct will not have an undue adverse effect on adjacent property, the character of the ne ghborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable ste)s have been taken to minimize any adverse effect of the proposed project 01 the immediate vicinity through building design, site design, landscaping, and screening. 6. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The proposed project is to be served by adequate public facilities and services. 8. The applicant has ~plied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. Lucie County Land Development Code, the site plan for the project to be known as Schwan's Distribution Facility, is hereby approved as shown on the site plan drawings for the project prepared by Friscia Engineering on Au~ust 26,2002 and last revised on 11/18/02 and date stamped received by the S1. Lucie County Community Development Director on 12/21/02, for the property described in Part B below The property on which this development will take place is described as follows: Lots 21 and 22, Block A, Kings Highway Industrial Park Unit 2, as recorded in Plat Book 32, Page 5 of the Public Records of St. Lucie County, Florida. (TAX 10#: 1335-802-0006-000/6 and 1335-802-0007-000/3) (Location: Kings Highway Industrial Park, approximately % mile wes' of the intersection of King's Highway and Commercial Circle) This site plan shall expire on December 13, 2004, unless a building permit or a site plan approval extension is granted in accordance with Section 11.02.06, S1. Lucie County Land Deve opment Code. All requests for site plan extension shall be accompanied by a request for a new certificate of capacity for the property and project described in this Order. The site plan approval granted under this Order is specifically conditioned to the requirement that the petitioner, Schwan's Sales Enterprises, Inc., including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities, includin~ but not limited to; the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. This Order shall become effective upon the date of approval indicated below. Should the propert; owner, developer or authorized agent wish to appeal any condition described in Section A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.0:;(B), S1. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. If this order expires or otherwise terminates, the certificate of capacity shall automatically terminate. A copy of this Order shall be mailed, return receipt requested to the developer and agent of record as ijentified on the site plan applications. H. A copy of this Order shall be attached to the site plan drawings described in Section A, which plan shall be placed on file with the SI. Lucie County Community Development Direc'or. I.
