LUCIE COUNTY, FLORIDA WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: Robert C. Fender, presented a petition for a change in future land use classification from RU (Residential Urban) and COM (Commercial) to COM (Commercial) for the property depicted on the attached maps as Exhibit "A" and described below. On March 20, 2003, the St. Lucie County Planning and Zoning Commission held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners denya change in future land use classification from RU (Residential Urban) and COM (Commercial) to COM (Commercial). On April 15, 2003, this Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of propertywithin 500 feet of the subject property. The proposed change in future land use is not consistent with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan. The proposed change in future land use is not consistent with the existing and proposed use of property in the surrounding area. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: The proposed Change in Future Land Use Classification from RU (Residential Urban) and COM (Commercial) to COM (Commercial) for that property depicted on the attached maps as Exhibit "A" and described as follows: SECTION 5, TOWNSHIP 36 SOUTH, RANGE 40 EAST. BEGINNING AT A POINT 60 FEET SOUTH AND 70.5 FEET WEST OF THE NORTHEAST CORNER OF THE SOUTHEAST 1/4 OF SAID SECTION 5, SAID POINT BEING THE INTERSECTION OF THE RIGHT-OF-WAY OF SOUTH 25TM STREET AND SOUTH RIGHT-OF-WAY OF MIDWAY ROAD, THE WESTERLY File No.: PA-02-005 Resolution 03-073 April 15, 2003 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 43 47 ALONG SAID SOUTH RIGHT-OF-WAY 218 FEET, THENCE, SOUTHERLY 222 FEET, THENCE EASTERLY 250 FEET TO THE WEST RIGHT-OF-WAY LINE OF SOUTH 25TH STREET, THENCE, NORTHERLYLY ALONG SAID WEST RIGHT-OF-WAY 224 FEET TO THE POINT OF BEGINNING. (Tax ID#: Part of 3405-411-0003-000/5) (Location: Southwest corner of the intersection of South 25th Street and Midway Road) owned by Robert C. Fender, is hereby denied. The St. Lucie County Community Development Director is hereby authorized and directed to cause the change to be made on the Official Zoning Map of St. Lucie County, Florida, and to make notation of reference to the date of denial of this resolution.
