LUCIE COUNTY, FLORIDA WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: CHANGE IN ZONING Harbor Branch Oceanographic Institution (Steven W. Knight, AIA, Agent) presented a petition for a change in zoning from the RS-2 (Residential, Single-Family- 2 du/acre), RM-5 (Residential, Multiple-Family- 5 du/acre), and I (Institutional) Zoning Districts to the PMUD (Planned Mixed-Use Development - Harbor Branch Oceanographic Institution) Zoning District for certain property in St. Lucie County, Florida. On January 15, 1998, the St. Lucie County Planning and Zoning Commission held a public heating, of which due notice was published and mailed to all property owners within 500 feet at least 10 days prior to the heating, and recommended to this Board that the requested change in zoning from the R/C (Residential/Conservation), AR-1 (Agricultural, Residential - 1 du/acre), RS-2 (Residential, Single-Family - 2 du/acre), RM-5 (Residential, Multiple- Family - 5 du/acre), I (institutional), CG (Commercial, General), IL (industrial, Light), IH (industrial, Heavy), and PMUD (Planned Mixed-Use Development - Harbor Branch) Zoning Districts to the PMUD (Planned Mixed-Use Development - Harbor Branch) Zoning District be granted. On February 3, 1998, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property and granted preliminary approval for the requested change in zoning fi:om the R/C (Residential/Conservation), AR-1 (Agricultural, Residential - 1 du/acre), RS-2 (Residential, Single-Family - 2 du/acre), RM-5 (Residential, Multiple-Family - 5 du/acre), I (Institutional), CG (Commercial, General), IL (Industrial, Light), IH (Industrial, Heavy), and PMUD (Planned Mixed-Use Development - Harbor Branch) Zoning Districts to the PMUD (Planned Mixed-Use Development - Harbor Branch) Zoning District. On February 3, 1998, this Board held a public hearing, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property and granted final approval, through Resolution 98-010, to the Harbor Branch Hurricane Shelter, and a change in zoning from the RM-5 (Residential, Multiple-Family - 5 du/acre) Zoning District to the PMUD (Planned Mixed-Use Development - Harbor Branch) Zoning District On July 21, 1998, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property and granted final approval to the property described below. The proposed change in zoning is consistent with the St. Lucie County Comprehensive Plan and meets the requirements of Section 11.06.03 of the St. Lucie County Land Development Code. SITE PLAN The petitioner is proposing the addition of 23,500 square feet of space to an existing 4,000 square foot visitor's center facility located at 5600 North U.S. Highway No. 1 for a total of 27,500 square feet of space. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet minimum technical requirements. On January 15, 1998, the St. Lucie County Planning and Zoning Commission held a public hearing, of which due public notice was published and mailed to all property owners within 500 feet at least 10 days prior to the hearing, and recommended to this Board that Preliminary Development Plan approval for the project known as Harbor Branch Oceanographic Institution be granted. On February 3, 1998, the St. Lucie County Board of County Commissioners held a public hearing, of which due public notice was published and mailed to all property owners within 500 feet at least 10 days prior to the hearing, and granted Preliminary Development Plan approval for the project known as Harbor Branch Oceanographic Institution. On July 21, 1998, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property, and granted Final Development Site Plan approval for the property described below. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 13. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 14. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 15. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 16. The proposed project will be served by adequate public facilities and services. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the Final Site Plan for the project to be known as Harbor Branch Oceanographic Institution - - A Planned Mixed-Use Development (Visitor's Center and Cultural Museum) be, and the same is hereby approved as shown on the site plan drawings for the project prepared by Hanson Engineering, Incorporated, dated July 15, 1998, and date stamped received by the St. Lucie County Community Development Director on July 15, 1998, for the following described property: BEING A PART OF THE SOUTH HALF OF SECTION 8, TOWNSHIP 34 SOUTH, RANGE 40 EAST, ST.
