LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: Rodney Hopkins, presented a petition for a Conditional Use Permit to allow for the operation of a Hotel/Motel (Time-Share) on property in the CG (Commercial, General), depicted on the attached maps as Exhibit "A" and described in Part "A" below, with said Conditional Use known as Royal Fountains. On March 20, 2003, the St. Lucie County Planning and Zoning Commission held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners approve a conditional use permit to allow the operation of a Hotel/Motel (Time-Share) in the CG (Commercial, General) Zoning District for the property depicted on the attached Maps and described in Part B below. On April 15, 2003, this Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. The proposed Conditional Use is consistent with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan and has satisfied the requirements of Section 11.07.03 of the St. Lucie County Land Development Code. The proposed Conditional Use will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. The proposed Conditional Use will be serviced by adequate public facilities and services. Rodney Hopkins, presented a petition for Site Plan Approval to re-construct an 18- unit hotel/motel in 5 buildings for the property depicted on the attached Maps and as described below in Part A to allow the operation of a hotel/motel (time-share) in the CG (Commercial, General)Zoning District. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development Code. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. The proposed project is to be served by adequate public facilities and services. The applicant has applied for and received an updated certificate of capacity, a copy of which is attached to this resolution, was granted by the Community Development Director on April 15, 2003. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: File No.: CU-03-003 Resolution 03-020 April 15, 2003 Page 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 CONDITIONAL USE PERMIT Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, a Conditional Use Permit for Rodney Hopkins, to allow the operation of a Hotel/Motel (Time- Share) in the CG (Commercial, General) Zoning District is hereby granted for the property depicted on the attached Maps and described as follows: BEGINNING AT A POINT ON THE WEST RIGHT-OF-WAY OF U.S. HIGHWAY NO. 1,800 FEET NORTH OF THE SOUTH LINE OF THE SE 114 OF NW 1/4 OF SECTION 17, TOWNSHIP 34 SOUTH, RANGE 40 EAST, AS MEASURED ALONG THE PERPENDICULAR, THENCE TURN AND RUN WEST, PARALLEL WITH THE SOUTH LINE OF THE SOUTHEAST 114 OF THE NORTHWEST 1/4 OF SAID SECTION, 300 FEET TO A POINT; THENCE TURN AND RUN SOUTH PARALLEL WITH THE WEST LINE OF THE SOUTHEAST 1/4 OF THE NORTHWEST 1/4 OF SAID SECTION, 300 FEET TO A POINT, THENCE TURN AND RUN EAST PARALLEL WITH SAID SOUTH LINE, 436.85 FEET TO THE WEST RIGHT-OF-WAY LINE OF U.S. HIGHWAY NO. 1; THENCE TURN AND RUN NORTHWESTERLY ALONG SAID WEST RIGHT-OF-WAY LINE OF U.S. HIGHWAY NO. 1,329.6 FEET TO THE POINT OF BEGINNING. ALL LYING AND BEING IN ST. LUClE COUNTY, FLORIDA. (Tax ID#: 1417-132-0002-00013) (Location: 4891 North U.S. Highway No. 1) The approvals and authorizations granted by this Resolution are for the purpose of obtaining building permits on this property and shall expire on April 15, 2004, unless the developer has obtained a building permit approval for the site plan described in Part F or an extension has been granted in accordance with Section 11.07.05(F) of the St. Lucie County Land Development Code. The Conditional Use approvals and authorizations granted by this Resolution shall be deemed to authorize only the particular use for which it has been issued and shall automatically expire and cease to be of any force or effect if the approved use shall, for any reason, be discontinued for a period of twelve (12) continuous months. A copy of this Resolution shall be attached to the site plan drawings described in Part F, which plan shall be placed on file with the St. Lucie County Community Development Director. SITE PLAN Pursuant to Sections 11.02.07, 11.02.09, 11.07.03, and 11.07.05(B) of the St. Lucie County Land Development Code, the proposed major adjustment to a minor site plan known as Royal Fountains, is hereby approved as shown on the site plan drawings for the project prepared by W.F. McCain & Associates, Inc., July 3, 2002, and received bythe File No.: CU-03-003 April 15, 2003 Resolution 03-020 Page 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 St. Lucie County Community Development Director on January 7, 2003, is being granted on the property described in Part A of this Resolution. The approvals and authorizations granted by this Resolution ara for the purpose of obtaining building permits on this property and shall expira on April 15, 2004, unless the developer has obtained a building permit approval for the site plan described in Part F or an extension has been granted in accordance with Section 11.07.05(F) of the St. Lucie County Land Development Code. The Conditional Use Permit and Final Site Plan approval granted under this rasolution is specifically conditioned to the raquirament that the petitioner, Rodney Hopkins, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal ragulatory authorities including, but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A of this Resolution. The Certificate of Capacity, a copy of which is attached to this rasolution, shall ramain valid for the period of Conditional Use approval. Should the Conditional Use/Site Plan approval granted by this rasolution expira or an extension be sought pursuant to Section 11.07.05(F) of the St. Lucie County Land Development Code, a new certificate of capacity shall be raquired. A copy of this rasolution shall be attached to the site plan drawings described in Part F, which plan shall be placed on file with the St. Lucie County Community Development Diractor. Further, the St. Lucie County Community Development Diractor is heraby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of St. Lucie County, Florida, and to make notation of reference to the date of adoption of this Resolution.
