A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO
ALLOW EDUCATIONAL SERVICES AND FACILITIES IN THE I
(INSTITUTIONAL) ZONING DISTRICT FOR CERTAIN PROPERTY
IN ST. LUCIE COUNTY, FLORIDA.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
testimony and evidence, including but not limited to the staff report, has made the following
determinations:
1. East Florida Primitive Baptist District Association. Inc.. presented a petition for a
Conditional Use Permit to allow educational services and facilities on property in the I
(Institutional) Zoning District, more particularly described below, with said Conditional
Use known as East Florida Primitive Baptist Church Association, Inc.
2. On June 20, 2002, the St. Lucie County Planning and Zoning Commission held a public
hearing on the petition, after publishing notice at least 10 days prior to the hearing and
notifying by mail all owners of property within 500 feet of the subject property, and
recommended that the Board of County Commissioners approve a conditional use
permit to allow educational services and facilities in the I (I nstitutional) Zoning District for
the property described in Part B below.
3. On August 20, 2002, this Board held a public hearing on the petition, after publishing
notice at least 10 days prior to the hearing and notifying by mail all owners of property
within 500 feet of the subject property.
4. The proposed Conditional Use is consistent with the goals, objectives, and policies of
the St. Lucie County Comprehensive Plan and has satisfied the requirements of Section
11.07.03 of the St. Lucie County Land Development Code.
5. The proposed Conditional Use will not have an undue adverse effect on adjacent
property, the character of the neighborhood, traffic conditions, parking, utility facilities, or
other matters affecting the public health, safety, and general welfare.
6. The proposed Conditional Use will be serviced by adequate public facilities and services.
7. A Certificate of Capacity as required under Chapter V, St. Lucie Land Development
Code, a copy of which is attached to this resolution, was granted by the Community
Development Director on August 20, 2002.

8. East Florida Primitive Baptist Church Association. Inc.. presented a petition for Site
Plan Approval to construct two - 4,320 square foot classrooms for a total of 8,640 square
feet of additional building space for the property described below to allow educational
services and facilities in the I (Institutional) Zoning District for an existing church facility
consisting of a 15,696 square foot church. The total square footage for the project is
now 24,336.
9. The Development Review Committee has reviewed the site plan for the proposed project
and found it to meet technical requirements of the Land Development Code and to be
consistent with the St. Lucie County Comprehensive Plan.
10. The proposed project is consistent with the general purpose, goals, objectives, and
standards of the St. Lucie County Comprehensive Plan and the St. Lucie County Land
Development Code.
11. The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other matters
affecting the public health, safety, and general welfare.
12. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping, and
screening.

13. The proposed project will be constructed, arranged, and operated so as not to interfere
with the development and use of neighboring property, in accordance with applicable
district regulations.
14. The proposed project is to be served by adequate public facilities and services.

15. The applicant has applied for and received an updated certificate of capacity, a copy of
which is attached to this resolution, was granted by the Community Development
Director on August 20, 2002.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
CONDITIONAL USE PERMIT
A. Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, a
Conditional Use Permit for East Florida Primitive Baptist District Association, Inc., to allow
educational services and facilities in the I (Institutional) Zoning District is hereby oranted for
the property described below, subject to the following conditions:

1. The number of students shall be limited to a maximum of 200.
2. The hours of operation for the educational facility shall be from 7 A.M to 6 P.M.,
Monday through Friday.
The property on which this Conditional Use Permit is being granted is described as follows:
THE NORTH "Iz OF THE SOUTHWEST 1/4 OF SECTION 32, TOWNSHIP 34 SOUTH, RANGE
40 EAST, LESS THE EAST 1560.00 FEET, THE WEST 371.54 FEET, THE NORTH 135.00
FEET, AND THE RIGHT-OF-WAY FOR JUANITA AVENUE.

3950 Juanita Avenue)
The approvals and authorizations granted by this Resolution are for the purpose of obtaining
building permits on this property and shall expire on August 20, 2003, unless the developer
has obtained a building permit approval for the site plan described in Part F or an extension
has been granted in accordance with Section 11.07.05(F) of the St. Lucie County Land
Development Code.
The Conditional Use approvals and authorizations granted by this Resolution shall be
deemed to authorize only the particular use for which it has been issued and shall
automatically expire and cease to be of any force or effect if the approved use shall, for any
reason, be discontinued for a period of twelve (12) continuous months.

Pursuant to Sections 11.02.07,11.02.09,11.07.03, and 11.07.05(B) of the St. Lucie County
Land Development Code, the proposed major adjustment to a minor site plan known as
East Florida Primitive Baptist Church Association, Inc., is hereby approved as shown on
the site plan drawings for the project prepared by Culpepper & Terpening, Inc., July 8,2002,
and received by the St. Lucie County Community Development Director on July 9,2002, is
being granted on the property described in Part B of this Resolution.

The approvals and authorizations granted by this Resolution are for the purpose of obtaining
building permits on this property and shall expire on August 20, 2003, unless the developer
has obtained a building permit approval for the site plan described in Part F or an extension
has been granted in accordance with Section 11.07.05(F) of the St. Lucie County Land
Development Code.
The Conditional Use Permit and Final Site Plan approval granted under this resolution is
specifically conditioned to the requirement that the petitioner, East Florida Primitive Baptist
Church Association, Inc. including any successors in interest, shall obtain all necessary
development permits and construction authorizations from the appropriate State and Federal
regulatory authorities including, but not limited to; the United States Army Corps of
Engineers, the Florida Department of Environmental Protection, and the South Florida Water
Management District, prior to the issuance of any local building permits of authorizations to
commence development activities on the property described in Part B of this Resolution.
The Certificate of Capacity, a copy of which is attached to this resolution, shall remain valid
for the period of Conditional Use approval. Should the Conditional UselSite Plan approval
granted by this resolution expire or an extension be sought pursuant to Section 11.07 .05(F)
of the St. Lucie County Land Development Code, a new certificate of capacity shall be
required.
A copy of this resolution shall be attached to the site plan drawings described in Part F,
which plan shall be placed on file with the St. Lucie County Community Development
Director. Further, the St. Lucie County Community Development Director is hereby
authorized and directed to cause the notation of this resolution to be made on the Official
Zoning Map of St. Lucie County, Florida, and to make notation of reference to the date of
adoption of this Resolution.
