OR BOOK 1786 PAGE 2365 IJ \ Recorded.08/.::9/0J 08.29 1 2 3 4 A RESOLUTION AMENDING CONDITION NUMBER 5 5 OF RESOLUTION 89-263 GRANTING 6 PRELIMINARY DEVELOPMENT PLAN FOR THE 7 PROJECT TO BE KNOWN AS PALM LAKE 8 GARDENS 9 10 WHEREAS, the Board of County Commissioners of S1. Lucie County, Florida, based on the 11 testimony and evidence, including but not limited to the staff report, has made the following 12 determinations: 13 14 1. On September 12, 1989, the Board of County Commissioners approved Resolution 15 89-263 granting Preliminary Planned Unit Development Plan approval for the projectto 16 be known as Palm Lake Gardens, subject to five (5) special/ limiting conditions. 17 18 2. On June 12, 1990, the Board of County Commissioners approved Resolution 90-121 19 granting Final Planned Unit Development Plan approval for the projectto be known as 20 Palm Lake Gardens, incorporating the Development Order conditions found in 21 Resolution 89-263. 22 23 3. The developers of the Palm Lake Gardens Subdivision have requested that the Board 24 reconsider a part of Condition Number 5 of Resolution 89-263, amending the 25 maximum lot coverage standard from an individual lot basis to project wide basis. 26 27 4. On August 19, 2003, this Board held public hearings on the petition, after publishing 28 notice at least 10 days prior to the hearing and notifying by mail all owners of property 29 within 500 feet of the subject property. 30 31 5. The proposed amendment to Resolution 89-263, is consistent with the general 32 purpose, goals, objectives, and standards of the S1. Lucie County Land Development 33 Code, the S1. Lucie County Comprehensive Plan, and the Code of Ordinances of S1. 34 Lucie County. 35 36 6. The proposed amendment to Resolution 89-263, will not have an undue adverse effect 37 on adjacent property, the character of the neighborhood, traffic conditions, parking, 38 utility facilities, or other matters affecting the public health, safety, and general welfare. 39 40 41 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of S1. Pursuant to Section 11.02.05 (F) of the S1. Lucie County Land Development Code, Condition Number 5 of Resolution 89-263 granting approval to the Preliminary Development Plan for the project to be known as Palm Lake Gardens, is hereby amended as follows: 5. Minimum yard standards within this development shall be as follows Front: Rear: Side: Side corner: Lot coverage: 30 feet 15 feet 1 0 feet 1 0 feet 20% by buildings of the overall proiect As part of the filino of each buildino permit application within this development proiect. the applicant for said permit shall be responsible to provide the County with a runnino assessment of the previouslv issued permits and the effect of the permit beina applied for as to compliance with the maximum coveraoe standard described above. Unless otherwise accounted for through the final planned unit development process, the use of electric security gates are not permitted within this development unless accompanied by a manned security system to ensure their fail safe operation. A copy of this Order shall be mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. D.
