A RESOLUTION GRANTING A CHANGE IN
ZONING FOR CERTAIN PROPERTY IN ST.
LUCIE COUNTY, FLORIDA AND FOR FINAL
DEVELOPMENT PLAN APPROVAL FOR A
PROJECT KNOWN AS PARCEL 11 @ THE
RESERVE, WILLOW PINES EAST.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
testimony and evidence, including but not limited to the staff report, has made the following
determinations:
CHANGE IN ZONING
1. Reserve Homes Ltd., L.P., presented a petition for a Change in Zoning from AR-
1 (Agricultural, Residential - 1 du/acre) to PUD (Planned Unit Development) or
certain property in St. Lucie County, Florida, the purpose of which is to receive
Final Planned Unit Development approval for a 24-unit duplex residential
development at the Reserve.
2. On July 10, 1984, this Board approved the application of Callaway Land and Cattle
Company, through Resolution 84-101, for Preliminary Planned Unit Development site
plan approval for a portion of the Reserve, a development of Regional Impact, known
as PUD #1 @ the Reserve.
3. On August 21, 1984, this Board approved the application of Callaway Land and Cattle
Company, through Resolution 84-129, for Final Planned Unit Development approval
for a portion of the Reserve, a Development of Regional Impact, known as PUD #1 @
the Reserve.
4. PUD #1 @ the Reserve was approved for a total of 796 residential units, an 18-hole
golf course and a three-hole practice golf course on a total of 439 acres.
5. On December 20, 1988, this Board approved Resolution 88-357 granting approval to
the Application for Development Approval (ADA) for the Development of Regional
Impact (DRI) known as the Reserve.
6. The Reserve DRI is approved as amended through Resolution 98-100, for a total of
4,100 dwelling units; 1,600,000 square feet of industrial development; 290,000 square
feet of commercial development; 100,000 square feet of office space and 250
hotel/motel rooms.
7. In April 1998, Callaway Land and Cattle Company conveyed ownership of portion of
the remaining undeveloped areas of PUD #1 @ the Reserve, and the unassigned

4 8. On July 20, 1999, this Board approved Resolution 99-143 granting approval for a
5 Major Adjustment to the approved Preliminary Planned Unit Development site plan for
6 the area known as PUD #1 @ the Reserve, which redistributed the remaining
7 unallocated residential units in the Reserve. The overall residential density for PUD #1
8 @ the Reserve is now 600 units.

10 9. On October 7, 2003, this Board held a public hearing on the petition of Reserve
11 Homes Ltd., L.P., after publishing a notice of such hearing in the Tribune and the
12 Port St. Lucie News and notifying by mail all property owners within the Reserve
13 Development.

15 10. The proposed zoning change is consistent with the St. Lucie County
16 Comprehensive Plan and has satisfied the requirements of Section 11.06.03 of
17 the St. Lucie County Land Development Code.

20 SITE PLAN

22 11. Reserve Homes Ltd., L.P., presented a petition for a Final Planned Unit Development

24 Reserve (a/k/a Willow Pines East).

The petitioner, Reserve Homes Ltd., L. P., is now seeking Final Planned Unit
Development site plan approval for a portion of the area within PUD #1 at the Reserve,
known as Parcel 11 @ the Reserve (alk/a Willow Pines East).
On October 7, 2003, this Board held a public hearing on the petition of Reserve
Homes Ltd., L.P., for Final Planned Unit Development approval for Parcel 11 @ the
Reserve (a/kla Willow Pines East) after publishing a notice of such hearing in the
Tribune and notifying by mail all property owners within the Reserve Development.
The Development Review Committee has reviewed the Final Planned Unit
Development site plan for the proposed project and found it to meet all technical
requirements and to be consistent with the future land use maps of the St. Lucie
County Comprehensive Plan, subject to the conditions set forth in Part E of this
Resolution.
The Development Review Committee has reviewed the Final Planned Unit
Development site plan for the proposed project and found it to be consistent with the
Preliminary Planned Unit Development plans for the area known as PUD #1 @ the
Reserve, subject to the conditions set forth in Part E of this Resolution.

standards of the St. Lucie County Land Development Code, the St. Lucie County
Comprehensive Plan, and the Code of Ordinances of St. Lucie County.

The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities or other
matters affecting the public health, safety and general welfare.
All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping and
screening.
The proposed project will be constructed, arranged and operated so as not to interfere
with the development and use of neighboring property, in accordance with applicable
district regulations.
The proposed project will be served by adequate public facilities and services.
The applicant has demonstrated that water supply; evacuation facilities and
emergency access are satisfactory to provide adequate fire protection.

2. Prior to the issuance of the final Certificate of Occupancy (CO) all tree
mitigation calculations shall be determined and satisfied, and are subject
to the approval of the County's Environmental Resources Division.
3. Prior to issuance of a land-clearing permit, the developer shall clearly
delineate all areas to be preserved and shall institute applicable
safeguards to ensure the health and viability of the protected trees.
These safeguards shall be in accordance with the requirements set forth
in the land-clearing permit.
4. Prior to the removal of any vegetation from the construction area for the
development, the applicant's representative and county staff shall identify
any gopher tortoises located in the proposed construction area and
relocate these tortoises to an appropriate upland buffer preserve.

5. The applicant shall be required to correct any damages to the existing
sidewalk along Commerce Center Drive resulting from improvements to
the proposed project site.
6. Prior to the issuance of any building permits for any portion of the site
plan described in this part, (Willow Pines East), the developers of this
project shall provide, or cause to be provided sufficient security in an
amount, manner and form acceptable to St. Lucie County, for the
signalization (including any necessary roadway alterations) at the
following locations:
1-95/Reserve Boulevard - southbound off-ramp
1-95/Reserve Boulevard - northbound off-ramp (if warranted)
7. Prior to the issuance of any building permits for any portion of the site
plan described in this part, (Willow Pines East), the developers of this
project shall provide, or cause to be provided to St. Lucie County, a
schedule for the widening of the existing bridge over 1-95 (St. Lucie
WesVReserve Boulevard) demonstrating how the obligations under
Condition number 76 of Resolution 98-100 will be addressed.
The property on which this site plan approval is being granted is described in
Part A.
The approvals and authorizations granted by this Resolution for the purpose of
obtaining building permits on this property, shall expire on October 7, 2005,
unless the developer has obtained a Final Plat approval for the site
plan/subdivision described in Part C or an extension has been granted in
accordance with Section 11.06.06(B)(3), St. Lucie County Land Development
Code. Unless otherwise addressed through the projects final construction plans,
all primary infrastructure work for this subdivision plat shall be completed no later
than October 7, 2005.

The Final Planned Unit Development Site Plan/General Site Plan approval
granted under this Resolution is specifically conditioned to the requirement that
the petitioner, Reserve Homes Ltd., L.P., including any successors in interest,
shall obtain all necessary development permits and construction authorizations
form the appropriate State and Federal regulatory authorities, including but not
limited to; the United Stated Army Corp of Engineers, the Florida Department of
Environmental Protection, and the South Florida Water Management District,
prior to the issuance of any local building permits of authorizations to commence
development activities on the property described in Part A.
The conditions set forth in Part C are an integral nonseverable part of the site
plan approval granted by this Resolution. If any condition set forth in Section C is
determined to be invalid or unenforceable for any reason and the developer
declines to comply voluntarily with that condition, the site plan approval granted
by this resolution shall become null and void.
