IMff3 ~~ RESOLUTION 03-228 FILE NO.: RZ-03-018 & PUD-G3-029 A RESOLUTION GRANTING A CHANGE IN ZONING FOR CERTAIN PROPERTY IN ST. LUCIE COUNTY, FLORIDA AND FOR PRELIMINARY AND PARTIAL FINAL DEVELOPMENT PLAN APPROVAL FOR A PROJECT KNOWN AS PGA HOTEL & OFFICE. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: CHANGE IN ZONING 1. Kenneth F. Lowe, Jr., presented a petition for a Change in Zoning from CG (Commercial General) to PNR (Planned Nonresidential Development) or certain property in St. Lucie County, Florida, the purpose of which is to receive Preliminary Planned Nonresidential Development approval for a 12,000 square foot office and Preliminary and Final Planned Unit Development approval for a 170-unit hotel within the Reserve. 2. On December 20, 1988, this Board approved Resolution 88-357 granting approval to the Application for Development Approval (ADA) for the Development of Regional Impact (DRI) known as the Reserve. 3. The Reserve DRI is approved as amended through Resolution 98-100, for a total of 4,100 dwelling units; 1,600,000 square feet of industrial development; 290,000 square feet of commercial development; 100,000 square feet of office space and 250 hotel/motel rooms. 4. The Development Review Committee has reviewed the Planned Nonresidential Development Plan and found it to meet all technical requirements and to be consistent with the future land use maps of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part C of this Resolution. 5. The Development Review Committee has reviewed the proposed Planned Nonresidential Development Plan and found it to be consistent with the Preliminary Planned Development Plans for the area known as PUD III @ the Reserve, subject to the conditions set forth in Part C of this Resolution. 6. On September 18, 2003, the Planning and Zoning Commission held a public hearing on the petition of Kenneth F. Lowe, Jr., after publishing a notice of such hearing in the Tribune and the Port St. Lucie News and notifying by mail all property owners within the Reserve Development. The proposed zoning change is consistent with the St. Lucie County Comprehensive Plan and has satisfied the requirements of Section 11.06.03 of the St. Lucie County Land Development Code. SITE PLAN Kenneth F. Lowe, Jr., presented a petition for a Preliminary Planned Nonresidential Development Plan for a 12,000 square foot office and Preliminary and Final Planned Nonresidential Development approval for a 170-unit hotel known as Parcel 37C at the Reserve (a/k/a PGA Hotel and Office). Lowe, Jr., is now seeking Preliminary Planned Nonresidential Development for a 12,000 square foot office building and Preliminary and Final Planned Nonresidential Development site plan approval for a portion of the area within PUD III at the Reserve, known as Parcel 37C @ the Reserve (a/k/a PGA Hotel & Office). f-L CD r..,) U'I "1:J D (j') 1'1'1 f-L LoJ f-L f-L On October 7, 2003, this Board held a public hearing on the petition of Reserve Homes Ltd., L.P., for Final Planned Unit Development approval for Parcel 37C @ the Reserve (a/k/a PGA Hotel & Office) after publishing a notice of such hearing in the Tribune and notifying by mail all property owners within the Reserve Development. The Development Review Committee has reviewed the Final Planned Unit Development site plan for the proposed project and found it to meet all technical requirements and to be consistent with the future land use maps of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part E of this Resolution. The Development Review Committee has reviewed the Preliminary Nonresidential Development plan for the 12,000 square foot office building and Final Planned Nonresidential Development site plan for the proposed project and found it to be consistent with the Preliminary Planned Unit Development plans for the area known as PUD '" @ the Reserve, subject to the conditions set forth in Part E of this Resolution. 17. The proposed project is consistent with the general purpose, goals, objectives and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 18. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety and general welfare. 19. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 20. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 21 . The proposed project will be served by adequate public facilities and services. 22. The applicant has demonstrated that water supply; evacuation facilities and emergency access are satisfactory to provide adequate fire protection. o :::D r.J:I o o ^ 23. The property on which the change in zoning from AR-1 (Agricultural, Residential - 1 du/acre) to PUD (Planned Unit Development) is being granted is described as follows: A Parcel of land being all of the Commercial Parcel 2 as shown on the Plat of Commerce Centre at the Reserve, recorded in Plat Book 37, pages 6, 6A and 6B, public records of St. Lucie County, Florida. Containing 6.926 Acres, more or less. SITE PLAN Pursuant to Section 11.02.05(B) of the St. Lucie County Land Development Code, the Partial Final Site Plan for the project to be known as Parcel 37C @ the Reserve. PGA Hotel, be, and the same is hereby, approved as shown on the site plan drawings for the project prepared by Thomas Lucido & Associates on July 18, 2003, last revised on July 30, 2003, and date stamped received by the St. Lucie County Community Development Director on August 5, 2003, subject to the following conditions: 1. All development activities in this parcel are subject to the applicable requirements of the final development order for the Reserve, Development of Regional Impact, last revised through Resolution No. 98- 100, and as may be amended in the future. 2. Prior to issuance of a land clearing permit, the developer shall delineate all areas to be preserved and shall institute applicable safeguards to ensure the health and viability of the protected trees. These safeguards shall be in accordance with the requirements set forth in the land clearing permit. 3. Prior to the removal of any vegetation from the construction area for the development, the applicant's representative and county staff shall identify any gopher tortoises located in the proposed construction area and relocate these tortoises to an appropriate upland buffer preserve. Prior to the issuance of a Certificate of Occupancy for any portion of the site plan described in this part, (PGA Village Hotel), the signalization of 1- 95 / Reserve Boulevard shall be installed and all necessary roadway alterations shall be completed at the following locations: 1-95/Reserve Boulevard - southbound off-ramp 1-95/Reserve Boulevard - northbound off-ramp (if warranted) 6. Prior to the issuance of a certificate of occupancy for the proposed hotel, the applicant will be responsible for repairing any damage to the existing sidewalk resulting from the clearing and construction of the hotel. The property on which this site plan approval is being granted is described in Part A. E. The approvals and authorizations granted by this Resolution for the purpose of obtaining building permits on this property, shall expire on October 7, 2005, unless the developer has obtained a building permit approval for the site plan described in Part C or an extension has been granted in accordance with Section 11.06.06(B)(3), St. Lucie County Land Development Code. F. The Final Planned Unit Development Site Plan/General Site Plan approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, Kenneth F. Lowe, Jr., including any successors in interest, shall obtain all necessary development permits and construction authorizations form the appropriate State and Federal regulatory authorities, including but not limited to; the United Stated Army Corp of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. G. The conditions set forth in Part C are an integral nonseverable part of the site plan approval granted by this Resolution. If any condition set forth in Section C is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this resolution shall become null and void. H.
