LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Westside Baptist Church, presented a petition for Major Site Plan approval to allow a 118-unit residential (age restricted, 55 and over) development to be known as Westside Baptist Retirement Village on 27.89 acres of land on the west side of South Jenkins Road, approximately 410 feet north of Briargate Lane, in the RM-5 (Residential, Multiple-Family - 5 du/acre) Zoning District for the property described in Part B below. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet all technical requirements and to be consistent with the future land use maps of the St. Lucie County Comprehensive Plan, subject to certain conditions set forth in Part A. 3. The proposed project is consistent with the general purpose, goals, objectives and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan and the Code of Ordinances of St. Lucie County. 4. With the conditions imposed pursuant to this Resolution, the proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect on the proposed project on the immediate vicinity through building design, site design including upland and wetland buffers, landscaping and screening. 6. With the conditions imposed in Part A of this Resolution, the proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. Ft. Pierce Utility Authority will provide water and sewer service to the proposed project. The applicant has demonstrated that water supply, evacuation facilities and emergency access are satisfactory to provide adequate fire protection. 9. A Certificate of Capacity, a copy of which is attached to this resolution, was granted by the Community Development Director on September 9, 2003. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the site plan for the project to be known as Westside Baptist Retirement Village, is hereby approved as depicted on the site plan drawings for the project prepared by Conceptual Design Group Inc., dated 10/24/02, last revised 7/11/03, and date stamped received by the St. Lucie County Community Development Director on 7/11/03, for the property described in Section B, subject to the following conditions: 1. Prior to issuance of any building permits for any use or activity within the Wests ide Baptist Retirement Village, the petitioner, their successors or assigns, shall convey to St. Lucie County, in manner and form acceptable to the St. Lucie County Attorney, the east 25 feet of the parcel for the future widening of South Jenkins Road. To the extent permitted under the County's Code and Compiled Laws, any such dedication may be considered eligible for Road Impact Fee Credits. C) :::D t:J:1 C) C) = I-'- 0:1 I-'- .p.. 2. Prior to the issuance of the first Certificate of Occupancy (CO) for the first residential building or structure, the developer shall provide a right turn lane on South Jenkins Road at the intersection of the project entrance to the Wests ide Baptist Retirement Village project site. 3. Prior to the issuance of the first Certificate of Occupancy (CO) for the first residential building or structure, the developer shall provide a concrete sidewalk, having a minimum width of six (6') feet, along the western side of South Jenkins Road, from the northern project limits to the southern project limits. -0 :I> G1 ITl ~".J (J"1 t,T1 4. The developer shall provide adequate intersection site lighting at the intersection of the Westside Baptist Retirement Village project entrance and South Jenkins Road. The lighting shall be installed utilizing acceptable Engineering Safety Standards. 5. Prior to the issuance of any Land Clearing Permits for the Westside Baptist Retirement development, the developers shall clearly delineate all areas to be preserved and/or protected. Delineation shall be by either the placing of silt fencing, safety fencing or similar type of materials. Flagging shall not be used except to guide the installation of the fencing materials. All land clearing activities shall be in accordance to the specific conditions/standards outlined in the Land Clearing Permit. The developer shall provide adequate measures to ensure the survivability of the relocated trees. If the trees do not survive, it shall be the responsibility of the applicant to mitigate for the trees at a 2:1 ratio. The property on which this Major Site Plan approval is being granted is described as follows: A parcel of land in the Northeast Quarter ot Section 25, Township 35 South, Range 39 East, St. Lucie County, Florida, being more particularly described as tollows: From the northeast corner ot atoresaid Section 25, run South 00012'22" West, 40.5 teet; thence run North 88024'08" West, 40 teet to the West right-ot-way line tor Jenkins road and the Point ot Beginning; thence continue North 88024'08" West, 1,555.91 teet to the East right-ot-way line tor Interstate Highway 95; thence run South 10 004'59" West, along said right-ot-way line, 88.84 teet; thence run South 04026'59" West, along said right-ot-way line, 518.75 teet; thence South 00026'58" West, along said right-ot-way, 695.45 teet; thence run South 89022'09" East, along the North line ot the Southwest Quarter ot the Northeast Quarter, a distance ot 328.11 teet; thence run North 00019'41" East, 669.97 teet to the Southwest corner ot the North halt ot the Northeast Quarter ot the Northeast Quarter; thence run South 88037'18" East, 1,283.41 teet to the West right-ot-way line ot Jenkins Road; thence run North 00014'22" East, along said right-ot-way line, 624.55 teet to the Point ot Beginning. Said land contains 27.89 acres, more or less. (Location: West side of South Jenkins Road, approximately 410 feet north of Briargate Lane (the entrance to the Briargate Residential Subdivision) The approvals and authorizations granted by this Resolution are for the purpose of obtaining future site plan/building permit approvals and shall expire on September 2, 2004, unless the developer has obtained final plat approval for this subdivision and the final record plat for this subdivision has been recorded in the land records of St. Lucie County, or an extension has been granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. Once the final plat or plats for this development have been recorded in the land records of the County, no further site plan extension will be required provided that development activities in the subdivision proceed in manner consistent with this approved site plan. a ::0 tt::f o o :::><:: I-'- ro I-'- +:-- "'T.J :::D Ci') fT1 ~,.J LT1 Ci'" The Major Site Plan approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, Westside Baptist Church, including any successors in interest, shall obtain all necessary development permits and construction authorizations form the appropriate State and Federal regulatory authorities, including but not limited to: the United States Army Corp of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. A Certificate of Capacity, a copy of which is attached to this resolution, was granted by the Community Development Director on September 9, 2003, which certificate shall remain valid for the period of Site Plan approval. F. A copy of this resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Community Development Director.
