AN ORDER GRANTING MINOR SITE PLAN
APPROVAL FOR THE PROJECT TO BE
KNOWN AS SEASIDE VILLAS
WHEREAS, the St. Lucie County Growth Management Director has reviewed the application
for site plan approval submitted by John Morris, reviewed the comments of the St. Lucie
County Development Review Committee on this application, and made the following
determinations:
A 4-unit residential condominium has been proposed for the project to be known as
Seaside Villas on the east side of SR A-l-A, immediately north of Holiday Out
Beach Access and south of Turtle Reef Condominium.
The Development Review Committee has reviewed the site plan for the proposed
project and found it to meet technical requirements of the Land Development Code
and to be consistent with the St. Lucie County Comprehensive Plan.
The proposed project is consistent with the general purpose, goals, objectives, and
standards of the St. Lucie County Comprehensive Plan and the St. Lucie County
Land Development Code.

The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other
matters affecting the public health, safety, and general welfare.
All reasonable steps have been taken to minimize any adverse effect of the
proposed project on the immediate vicinity through building design, site design,
landscaping, and screening.
The proposed project will be constructed, arranged, and operated so as not to
interfere with the development and use of neighboring property, in accordance with
applicable district regulations.
The proposed project is to be served by water services by Martin County Utilities and
St. Lucie County Utilities will be providing sewer services to the subject property.
The applicant has applied for and received a certificate of capacity, a copy of which
is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County
Land Development Code.

NOW, THEREFORE, BE IT ORDERED:
Pursuant to Section 11.02.03(A)(5) of the St. Lucie County Land
Development Code, the Final Site Plan for the project to be known as
Seaside Villas be, and the same is hereby, approved as shown on the site
plan drawings for the project prepared by Thomas Lucido & Associates, on
August 23, 2003 and last revised on March 11, 2004 and date stamped
received by the St. Lucie County Growth Management Director on March 16,
2004 subject to the following conditions:
The Seaside Villas project shall only be developed with Single-family
condominium units. No duplex or multi-family units shall be permitted
to be constructed within the project boundaries. There shall be no
platting shall be permitted for this project.
The Seaside Villas condominium shall be limited to one shared dune
crossover. Any dune vegetation damaged or destroyed during the
construction of the beach dune crossover shall be required to be
replaced with the same species or other native dune vegetation. All
such replacements shall be completed prior to the issuance of a
Certificate of Occupancy for the proposed building.
As part of the construction drawing submittal for the project, the
applicant shall be required to complete the assignment of all
Equivalent Residential Connections (ERC) reservations from the
parent parcel to the four units within the subdivision.
Prior to the issuance of any Land Clearing Permits for the Seaside
Villas project, the developers shall clearly delineate all areas to be
preserved and/or protected. Delineation shall be by either the placing
of silt fencing, safety fencing or similar type of materials. Flagging
shall not be used except to guide the installation of the fencing
materials. All land clearing activities shall be in accordance to the
specific conditions/standards outlined in the Land Clearing Permit.

Prior to the issuance of any building permits for any structures within
this project, the developers shall be required to remove all exotic
vegetation that has encroached into this site.
Prior to the issuance of any building permits for any structures within
this project, the developers of this project shall submit to St. Lucie
County copies of all revised, condominium documents effecting this
development.
The applicant shall be required to correct any damages to the existing
sidewalk/recreation path along SR A-1-A (known as Indian River
Lagoon Trace) resulting from improvements to the proposed project

site. All driveways connection onto SR A-1-A shall be designed in
manner consistent with other driveways connection along the length
of the Indian River Lagoon Trace.
Prior to the issuance of any building permits for any structure, and in
addition to any building permit fees and charges, that may be due from
this project, the developers shall pay all applicable Impact Fees and
other development fees as required under Section 3.01.03(AA)(7) of the
St. Lucie County Land Development Code.
The property on which this site plan approval is being granted is described
as follows:
FROM THE INTERSECTION OF THE NORTH LINE OF THE GOVERNMENT LOT 2 OF
SECTION 12, TOWNSHIP 37 SOUTH, RANGE 41 EAST AND THE EAST RIGHT-OF-WAY OF
HIGHWAY A-l-A, RUN NORTHWESTERLY ON RIGHT-OF-WAY A DISTANCE OF 774.85
FEET FOR A POINT OF BEGINNING. THENCE, CONTINUE NORTHWESTERLY ON SAID
RIGHT-OF-WAY, A DISTANCE OF 116.06 FEET TO THE SOUTH LINE OF PARCEL AS
DESCRIBED IN O.R. BOOK 192, PAGE 1116, THENCE NORTH 89°56'22'' EAST TO THE
SHORE OF THE ATLANTIC OCEAN; THENCE SOUTHEASTERLY ON SHORE A DISTANCE
OF 116 FEET MORE OR LESS, TO A POINT BEARING NORTH 89056'22" EAST FROM THE
POINT OF BEGINNING; THENCE SOUTH 89o56'22" WEST A DISTANCE OF 489 FEET MORE
OR LESS TO THE POINT OF BEGINNING.
Parcel contains 1.17 acres more or less

The approvals and authorizations granted by this CD-Order are for the purpose of
obtaining building permits on this property, shall expire on April 29, 2006, unless the
developer has obtained building permits for the site plan described in Part A or an
extension has been granted in accordance with Section 11.02.06, St. Lucie County
Land Development Code.
The Final Site Plan approval granted under this resolution is specifically conditioned
to the requirement that the petitioner, John Morris, including any successors in
interest, shall obtain all necessary development permits and construction
authorizations from the appropriate State and Federal regulatory authorities
including, but not limited to; the United States Army Corps of Engineers, the Florida
Department of Environmental Protection, and the South Florida Water Management
District, prior to the issuance of any local building permits of authorizations to

commence development activities on the property described in Part A.
A copy of this Order shall be attached to the site plan drawings described in Part A,
which plan shall be placed on file with the St. Lucie County Growth Management
Director and mailed, return receipt requested to the developer and agent of record as
identified on the site plan applications.
The certificate of capacity, attached as Exhibit A, shall be valid for the same period
as this order. If this order expires or otherwise terminates, the certificate of capacity
shall automatically terminate.
G. This order shall be recorded in the Public Records of St. Lucie County.
