A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA,
ADOPTING A REVISED FINAL ASSESSMENT ROLL
FOR THE BECKER ROAD MUNICIPAL SERVICES
BENEFIT UNIT TO RE-ALLOCATE ASSESSMENTS AS
5ET FORTH IN THE REVISED FINAL ASSESSMENT
ROLL; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, on ~Tanuory 10, lgc)5, pursuant to Chapter 1-13.5 of the St. Lucia
County Code of Ordinances and Compiled Laws (the "Code"), the Board of County
Commissioners for St. Lucia County (the "Board") adopted Resolution No. gS-012
initially determining that the creation of the Backer Road Municipal Services Benefit
Unit (the "Backer Road MSBU") to fund the cost of a project to construct a portion
of a realigned Backer Road (the "Project") is in the best interest of St. Lucia County;
a copy of a map showing the boundaries of the Backer Road MSBU is attached as
Exhibit "A"; and
WHEREAS, on March 13, :[c)c)5, the City Council of the City of Port St. Lucia,
adopted Ordinance No. c)5-~4 authorizing St. Lucia County to create a MSBU within
the boundaries of the City of Port St. Lucia to construct and improve Backer Road;
and
WHEREAS, on September 5, lcJ95, the Board adopted Resolution No. c)5-164
creating the Backer Road MSBU; and thereby, (~) adopted the Preliminary
Assessment Roll for the Backer Road MSBU which was based on the estimated costs
for the Project, (2) authorized the levy of a special non-ad valorem assessment (the
"Special Assessment") within the Backer Road MSBU in the amount set forth in the
Preliminary Assessment Roll, (3)authorized the collection of the Special Assessment
by the uniform method of collection pursuant to Chapter Zc)7, Florida Statutes,
beginning with the tax bill forlC)CJ7 for a period of 20 years, and (4) authorized the
County Engineer to proceed with the Project; and

WHEREAS, on December 17, 1996 pursuant to Section 197.3632, Florida
Statutes, the Board adopted Resolution No. 96-25? which stated the Board's intent
to use the uniform method of collecting the Special Assessments levied by the Backer
Road MSBU; and
WHEREAS, on ,Tuly 10, 2001, the Board adopted Resolution No. 01-161
approving the Final Assessment Roll upon review of the final costs for the completed
Project and determined that the final costs were lower than the estimated costs as
set forth in the Preliminary Assessment Roll and therefore the Special Assessments
were credited in accordance with Section 1-13.5-7 of the Code; and
WHEREAS, on September 28, 2004, pursuant to Section 197.492, Florida
Statutes, the Board adopted Resolution No. 04-257 after reviewing and confirming an
engineer's report prepared by Camp, Dresser & McKee, Inc. to re-allocate existing
assessments due to plat abandonments and newly created platted subdivisions. The
Revised Final Assessment Roll is attached hereto as Exhibit "B".
NOW, THEREFORE, BE TT RESOLVED by the Board of County Commissioners
for St. Lucie County, Florida, as follows:
Section 1: The Revised Final Assessment Roll for the Backer Road MSBU
(Exhibit "B") is hereby approved and confirmed and the Revised Final Assessment Roll
is substituted for the Final Assessment Roll.
Section Z: Except for the substitution of the Amended Final Assessment Roll
for the Final Assessment Roll, all of the findings, determinations, and actions made or
taken by the Board pursuant to Resolutions Nos. 95-01;>, 95-164, 96-252 and 01-161
including but not limited to the collection of the Special Assessments by the uniform
method beginning with the tax bill for 1997 for a period of 20 years, shall remain in
full force and effect and apply equally to the Amended Final Assessment Roll.
Section 3: This Resolution shall be effective upon adoption.
