LUCIE VILLAGE (HURRICANE ;rEANNE) WHEREAS. the Mayor of the Town of 5,. Lucia Village has made the following determinations: 1. Pursuant ,o Section 870.042, Florida 5,o,u,es, the Mayor has the power to declare a state of local emergency within the Town of St. Lucia Village to provide for the health and sofe,y of persons and properly and to exercise the emergency powers conferred in Sections 870.041 - 870.047, Florida Statutes. 2. The National Hurricane Center has identified Hurricane ~Teanne as o Category 2 hurricane and has issued Hurricane Warnings for ,he east coast of Florida, including S,. Lucia Coun,y. 3. The presence of Hurricane ~Teanne has placed ,he Town of 5,. Lucia Village in a s,o,e of emergency, exposing ,he citizens ,hereof ,o ,he ,hrea, of imminen, violence and ,o danger ,o life end proper,y. 4. On September-~q~, 2004, o, ? c.c,, A .m., the Mayor declared a s,o,e of local emergency in the Town of St. Lucia Village (copy at,ached). §. In order ,o respond ,o such emergency, upon this declaration, the Mayor is ou,horized to ini,iat¢ and ,aka such ac,ions au,horized by Sec,ions 870.041 - 870.047. Florida Statutes. 6. As a result of the effects of Hurricane ~Teonne, there is a clear and present danger of civil disorder in the Town of St. Lucie Village and widespread disobedience of the law and it is necessary to order certain emergency measures as hereinafter defined in order to suppress the threat to public peace which now exists and to prevent substantial injury to persons or property. NOW, THEREFORE, T am issuing the following order: 1. Effective September, S'-_?, 2004, at {.-: ors f~ .tn., the following emergency measures are effective in the Town of ,St. Lucie Village: (A) The sale or distribution of any alcoholic beverage, with or without the payment or a consideration therefor is prohibited. (B) The possession on any person in a public place of any portable container containing any alcoholic beverage is prohibited. (¢) All places of public assemblage are closed except designated shelters. 2. This Order shall remain in effect for seventy-two (72) hours unless terminated, modified or extended. This Order shall automatically terminate upon a declaration terminating the state of local emergency or upon further directive of the Mayor or the I~oard of ~,ldermen. This Order may be modified at any time by subsequent Orders of the Mayor or the ~oard of Aldermen. This Order may be extended in not more than seventy-two (72) hour increments by subsequent directives issued by the Mayor with the concurrence of the Board of Aldermen by duly enacted ordinance or resolution in regular or special session. 3. This Order shall, os promptly as practicable, be filed in the office of the Village Clerk and delivered to the appropriate news media for publication and radio and television broadcast thereof.
