DECLARING A CURFEW IN
THE TOWN OF ST. LUCRE ¥1LLAGE
{HURRICANE FRANCES)
WHEREAS, the Mayor of the Town of St. Lucia Village h~ made the following
determinations:
1. Pursuant tO Section 870.0~,2. Florida Statutes, the Mayor has the ;ower to
dec,are a state of local emergency 'within t~e Town of Si. Luci~ V~ila~e to provide for the
hea~th and sate~y of ~er$ons and property and to exercise the emergency powers conferred in
Sections 870.0~ - 870.047, Florida Statutes.
The Na:iona~ Hurricace Center has i3entifi~ Hurricane Frances as a Category 4
hurricane end ha~ issued Hurricane Warnings for ~he east coast of Florida, includ[n~ St. L~cie
County,

state of emergency, exposing the citizens thereof [o the threat of imminent viote~ce and to
danger [o life and property.
4. On September _~, 2004, at ~.~ ~.m,, the Mayor declared ~ state of local
emergency in t~e Town of St. Lucia Vi;lage (copy attached).
5. In order [o rss~o~d to such emergency, ~pon this declaration, the Mayor i$
authori~e~ to initiste and take such actions authorizsd by Sections 870.041 - 970.047, Florida
Statu[es.
6. As a result of the effects of Hurricane Frances, there is ~ clear and present
danger of ciwl disorder in the Town of St. Lucia Village and widespresd disobedience of the
law and it is necessary t~ declare a curfew ~s hereinafter defined in order [~ s~ppress the
t~reat to F, ub:ic peace whic~ now exists and to prevent s~Jbstantial injury to persons or
property.
NOW, THEREFORE, I am issuing the fotlowin~c Order:
1. Effective September ~, 2004, at~_-~_~.~ ~_...m., there is a curfew ~mpesed from
~'~z~_~.O~.m, toT'.;O~_ m, ir~ ~:he Town .~f St, Lucia Village. During the curfew, all pedestrian and
vehicular movement o,jtside hen~es is prohibited except as provided herein. All per$or~s in the
Town of St. Lucia Vi!Iago are commandeC, to remain in tt~eir homes during the hours of curfew
unless otherwise c~irected or authorized by Village, County, State of F!orida or federal officials.
2. The curfew shall net ac~pl¢ to those persons wh~ need to trave', in connection
with designatect essen',iat services incluCing, but not limited to, emergency personnel, such as
an-,bu~ance driv6rs, firefighters, hosl~ital workers including physicians, law enforcement officers,
and utility workers.
3. Thi.~ Oree. r imposing a curfew shall remain in effect for seventy-two (721 hours
unless terminate~, mcdified or extended. This Order imposing a curfew shaJl autom.~,ticaily
terminate upon a d~clar~tion ~erm;natin§ the state of local emergency or upon further Order
the Mayor or the ~oard of Aldermen. Th;s Order imposing a curfew may be modifiec at any
-.ime by subsequent OrQers of the Mayor er the Board of Aidermen. This O~der imposin9 a
c~Jrfew may be extended ;n not m~re than seventy-two (72) hoL~r increments by subsequent
Orders issued ~y the Mayor with the conc,,rrence of the Board of Atdermen ;3y du!y enacted
ordinance or resoiutior~ in regular or special ~ession.

4. This Order shall, as promptly as practicable, be filed in the
Clerk. and delivered to ~he appropri~t~ news m.edia for publication and radio and television
broadcast thereof.
