AN ORDER OF THE ST. LUCIE COUNTY
SHERIFF ORDERING CERTAIN EMERGENCY MEASURES IN
UNINCORPORATED ST. LUClE COUN%Y
(HURRICANE FRANCES}
WHEREAS, THE St. Lucie County Sheriff has made the following determinations:.
1, Pursuan[ to Section 870.042., Florida Statutes, the St. Lucid County Sheriff
has the power to declare a state of Ioca! emergency within the unincorpor.~ted are~ of St.
Lucie County To provide for the health and safety of persons and property and to exercise
',he emergency powers conferred in Sections 870.041 - 370.047, Florida Statutes.
2. The National Hurricane Center has identified Hurricane Frances as ~ Category
4 hurricane and has issued Hurricane Warnings for the east coast of Florida, including St,
Lucid County.
3. The presence of Hurricane Frances has placed unincorporated St. Lucie
County in a state of emergency, exposmg the citizens thereof to the threat of imminent
violence and to danger to life and proper~y.
4. On September L., 2004, atcJ'.~_~__,~__.m., the St, Lucie County Sheriff
declared a state of !ocat emergency in unincorporated St. Lucie County (copy ~ttached).
5. In order to respond to such amergenc¥, upon this declaration, the Sheriff is
authorized to initiate and toke such actions authorized by Sections 870.0z~l ' $70,0~7,
Florida Statutes.
As a result of the effacts cf Hurricane Frances, there is a clear and present
danger of civil d:,sorder in unincomor~ted St. Lucie County and widespread disobedience of
the law and it "s necessary to orcter certain emergency measures as hereinafter defined in
order to suDpress the threat to public pasco which now exists and lo prevent substantiai
injury to persons or property.

NOW, THEREFORE, I am issuing the following order.

measures are effective for all unincorporated St. Lucia County:
(A) The sale or distribution of any alcoholic beverage, with or without the
payment or a consideration therefor ~s ~rohib~t~d-
(B~ The po~essior, on any person in a public piece of aW portable
container con~aining an~ aicoholic beverage is prohibited.
{C) All pl~ces of mjblic assemblage are closed except designated shelters.
This Order shall remain ,n effect for seventy-two (72) hours unless
terminated, modified or extended. This Order shail automatically terminate upon a
declarer on terminating the state of local emergency or upon further directive of the Sheriff
or the Board of County Commissioners. Th~s Order may be modified at any rime by
subsequent directive of the Sherif~ or the Board of County Commissioners. This Order may
be extended in not more than seventy-two (~2) hour increments by subseqden~ directives
issued by ~he Sheriff with the concurrence of ~he Board of County Commissioners by duly
.enacted ordinance or resolution in regular or special session.
3. This Order sha~l, a~ promptly as practicabie, be filed in the office o~ the Clerk
of the Circuit Court and delivered to the approonate news media for publication and radio
and television broadcast :hereof,
