LUCIE COUNTY (HURRICANE FRANCES) WHEREAS, THE St. Lucie County Sheriff has made the following determinations: 1. Pursuant to Section 870.042, Florida Statutes, the St. Lucie County Sheriff has the power to declare a state of local emergency within the unincorporated area of St. Lucie County to provide for the health and safety of persons and property and to exercise the emergency powers conferred in Sections 870.041 - 870.047, Florida Statutes. 2. The National Hurricane Center has identified Hurricane Frances as a Category 4 hurricane and has issued Hurricane Warnings for the east coast of Florida, including St. Lu¢ie County. 3. The presence of Hurricane Frances has placed unincorporated St. Lucie County in a state of emergency, exposing the citizens thereof to the threat of imminent violence and to danger to life and property. 4. On September [ , 2004, atq~h,~C) .m., the St. Lucie County Sheriff declared a state of local emergency in unincorporated St. Lucie County (copy attached). 5. In order to respond to such emergency, upon this declaration, the Sheriff is authorized to initiate and take such actions authorized by Sections 870-041 - 870-047, Florida Statutes. 6. As a result of the effects of Hurricane Frances, there is a clear and present danger of civil disorder in unincorporated St. Lucie County and widespread disobedience of the law and it is necessary to declare a curfew as hereinafter defined in order to suppress the threat to public peace which now exists and to prevent substantial injury to persons or property. Effective September ~ , 2004, at~'.CO ~__.m., there is a curfew imposed from f5;~::~_.m, toT;~C::~_.m, in unincorporated St. Lucie County. During the curfew, all pedestrian and vehicular movement outside homes is prohibited except as provided herein. All persons in unincorporated St. Lucie County are commanded to remain in their homes during the hours of curfew unless otherwise directed or authorized by St. Lucie County, State of Florida or federal officials. 2. The curfew shall not apply to those persons who need to travel in connection with designated essential services including, but not limited to, emergency personnel, such as ambulance drivers, firefighters, hospital workers including physicians, law enforcement officers, and utility workers. 3. This Order imposing a curfew shall remain in effect for seventy-two (72) hours unless terminated, modified or extended. This Order imposing a curfew shall automatically terminate upon a declaration terminating the state of local emergency or upon further Order of the Sheriff or the Board of County Commissioners. This Order imposing a curfew may be modified at any time by subsequent Orders of the Sheriff or the Board of County Commissioners. This Order imposing a curfew may be extended in not more than seventy-two (72) hour increments by subsequent Orders issued by the Sheriff with the concurrence of the Board of County Commissioners by duly enacted ordinance or resolution in regular or special session. 4. This Order shall, as promptly as practicable, be filed in the office of the Clerk of the Circuit Court and delivered to the appropriate news media for publication and radio and television broadcast thereof.
