Lucia Police Chip has made the following determinations: 1. Pursua~,t ~o Sec=ion 870.042, Florida Statutes, the Police Chief has the power ~c dec~sre a state of local emergency within the City of Port St. Lucie ~c proviCs for tr, e heait~ and ssfe~y of persons and property 8nd to exercise the emergency powers conferred i~ Sections 870,04! - 870.047, Florida Statu~es. 2. The National Hurricane Center has identified Hurricane Frances as a Category z, hurricane and has issued Hurricane Warnings for ~he eas~ coas~ cf Florida, including St. Lucia C~un~y~ 3. The presenc~ o¢ Hurricane Frances has placed the City of Po~ St. Luci~ in a state of emergency, exposing the citizens thereof to the threa~ ~f imminent violence and to dander'to life and proper~y. 4. On Septemger ~_, 2004, st _~.,~.m., the Po~ Si, Lucia Police Chief declared a sta;e of local emergency in the C:ty of Port St. Lucia {copy a~eched). 5. )n orcer to respond to such emergency, upon this dec;ara~ion, ;he Police Chief is authorizeC ;c initiate and ~ake s¢ch actions ~u~horized by Sec[ions 870.041 - 870.047, Florida St~tdteS.
