ORDERING CERTAIN EMERGENCY MEASURES IN
CITY O~ PORT ST. LUCIE
(HURRICANE FRANCES)
WHEREAS, The Po~ Si. Lucia Police Chip has made the following determinations:
1. Pursua~,t ~o Sec=ion 870.042, Florida Statutes, the Police Chief has the
power ~c dec~sre a state of local emergency within the City of Port St. Lucie ~c proviCs for
tr, e heait~ and ssfe~y of persons and property 8nd to exercise the emergency powers
conferred i~ Sections 870,04! - 870.047, Florida Statu~es.
2. The National Hurricane Center has identified Hurricane Frances as a Category
z, hurricane and has issued Hurricane Warnings for ~he eas~ coas~ cf Florida, including St.
Lucia C~un~y~
3. The presenc~ o¢ Hurricane Frances has placed the City of Po~ St. Luci~ in a
state of emergency, exposing the citizens thereof to the threa~ ~f imminent violence and to
dander'to life and proper~y.
4. On Septemger ~_, 2004, st _~.,~.m., the Po~ Si, Lucia Police Chief
declared a sta;e of local emergency in the C:ty of Port St. Lucia {copy a~eched).
5. )n orcer to respond to such emergency, upon this dec;ara~ion, ;he Police
Chief is authorizeC ;c initiate and ~ake s¢ch actions ~u~horized by Sec[ions 870.041 -
870.047, Florida St~tdteS.
As a resuh of the er'acts of Hurricane Frances, there is a clear and pfesen~
danger ef civil disorder m ~ne City of Port S~ Lucia and wicespreao dJsobgdience
iaw and it i5 necessar'¢ to order certain emergencl, measures ~s heroic, ar;er defined in order
;o suppress ~he threat ~o public peace which now exis~ and to 2r~ven: substantial injury
persons or property.
NOW, THEREFORE, J sm ;ssuing the fotl~v,'ir~g or~er:
1. Effective SepTember ~2~_, 2004, &~ _(~_ ~)_.rn., the fallowing emergency
measures are ef. fec~ive in the C;:t¥ of Fort St. Lucia:
(A; The sale or Ois:ri~,~tio,~ of any alcoholic beverage, w!¢, or without
payment or a consideration therefor ;s prohibited.
(B) The ~osses.~ion or~ any person ;n ~ public place ef any' portable
container con;alning any ~Icehotic beverage is prohibited.
(Cj ~l: places of public asserr, blage are closed except designated she;tars.
2, This Ore, er sh~ll remain i.~ effect for seventy-two (72) hours unless
termir, a.zeo, modified or extended. Thi~ Order shall au~.emadcatly terminate upon

Chief or the Port St. Lucia City Council. This Order' may bs modified zt ~ny time by
