DECLARING A STATE OF LOCAL E~ERGENCY IN
THE CITY OF PORT ST. LUCIE
(HURRICANE FRANCES)
WHEREAS, the Port St. Lucie Police Chief has made the following determinations:
1. Pursuant to Section 870.042, Florida Statutes, the Police Chief has the
power to declare a state of emergency within the City of Port St. Lucie to provide for the
health and safety of persons and property and to exercise the emergency powers
conferred in Sections 870.041 - 870.047, Florida Statutes.
2. The National Hurricane Center has identified Hurricane Frances as a
Category 4 hurricane and has issued a Hurricane Warning for the east coast of Florida,
including St. Lucie County.
3. The presence of Hurricane Frances has placed the City of Port St. Lucie in o
state of emergency, exposing the citizens thereof to the threat of imminent violence and
to danger to life and property.
4. In order to respond to such emergency, upon this declaration, the Police
Chief is authorized to initiate and take such actions authorized by state law during the
term of such local state of emergency.
5. A state of emergency is declared in the City of Port St. Lucie effective
immediately upon signing this t/ day of September 2004, at c] ~__.m.
6. Such Declaration shall remain in full force and effect for seventy-two (72)
hours unless extended in seventy-two (72) hour increments with the concurrence of the
Port St. Lucie City Council or sooner rescinded by the Port St. Lucie City Council, the
Governor or the Police Chief.
7. This Order shall, as promptly as practicable, be filed in the office of the
City Clerk and delivered to the appropriate news media for publication and radio and
television broadcast thereof.
