ORDERING CERTAIN EMERGENCY MEASURES IN
THE CITY OF PORT ST. LUCIE
(HURRICANE JEANNE)
WHEREAS, the Port St. Lucie Police Chief has made the following determinations:
1. Pursuant to Section 870.042, Florida Statutes, the Police Chief has the
power to declare a state of local emergency within the City of Port St. Lucie to provide for
the health and safety of persons and property and to exercise the emergency powers
conferred in Sections 870.041 - 870.047, Florida Statutes.
2. The National Hurricane Center has identified Hurricane Jeanne as a Category
2 hurricane and has issued Hurricane Warnings for the east coast of Florida, including St.
Lucie County.
3. The presence of Hurricane Jeanne has placed the City of Port St. Lucie in a
state of emergency, exposing the citizens thereof to the threat of imminent violence and to
danger to life and property.
4. On September,.~, 2004, at IO:~ ,,~ .m., the Port St. Lucie Police Chief
declared a state of local emergency in the City of Port St. Lucie (copy attached).
5. In order to respond to such emergency, upon this declaration, the Police
Chief is authorized to initiate and take such actions authorized by Sections 870.041
870.047, Florida Statutes.
6. As a result of the effects of Hurricane Jeanne, there is a clear and present
danger of civil disorder in the City of Port St. Lucie and widespread disobedience of the
law and it is necessary to order certain emergency measures as hereinafter defined in order
to suppress the threat to public peace which now exists and to prevent substantial injury
to persons or property.
NOW, THEREFORE, I am issuing the following order:
1. Effective September,,~ , 2004, at ~:['(:; ~___.m., the following emergency
measures are effective in the City of Port St. Lucie:
(A) The sale or distribution of any alcoholic beverage, with or without the
payment or a consideration therefor is prohibited.
(B) The possession on any person in a public place of any portable
container containing any alcoholic beverage is prohibited.
(C)
All places of public assemblage are closed except designated shelters.
2. This Order shall remain in effect for seventy-two (72) hours unless
terminated, modified or extended. This Order shall automatically terminate upon a
declaration terminating the state of local emergency or upon further directive of the Police
Chief or the Port St. Lucie City Council. This Order may be modified at any time by
subsequent directive of the Police Chief or the Port St. Lucie City Council. This Order may
be extended in not more than seventy-two (72) hour increments by subsequent orders
issued by the Police Chief with the concurrence of the Port St. Lucie City Council by duly
enacted ordinance or resolution in regular or special session.
3. This Order shall, as promptly as practicable, be filed in the office of the City
Clerk and delivered to the appropriate news media for publication and radio and television
broadcast thereof.
