LUCIE COUNTY ADMINISTRATOR DECLARTN6 A CURFEW (HURRICANE ,TEANNE) WHEREAS, The St. Lucia County Administrator has made the following determinations: 1. Pursuant to Section 25;>.38, Florida Statutes, political subdivisions of the state have the power during a state of local emergency to provide for the health and safety of persons and property. ?. The Board of County Commissioners of St. Lucia County has adopted Resolution No. 00-277 authorizing the St. Lucia County Administrator and the St. Lucia Public Safety Director to exercise certain emergency powers and authority during a local emergency. 3. The National Hurricane Center has identified Hurricane ~Teanne as a Category 2 hurricane and has issued Hurricane Warnings for the east coast of Florida, including St. Lucia County. 4. The presence of Hurricane ,Teanne has placed St. Lucia County in a state of emergency, exposing the citizens thereof to danger to life and property. 5. On September ~'~l , 2004, at -/:c~_~, ~___.m., the St. Lucia County Public Safety Director declared a state of local emergency (copy attached). 6. Tn order to respond to such emergency, upon this declaration, the County Administrator or his designee is authorized to initiate and take such actions authorized by Resolution No. 00-277 (copy attached) for and on behalf of the Board of County Commissioners during the term of such local state of emergency. 7. Based on the recommendation of the Public Safety Director on the advice of state and local law enforcement officials, including but not limited to the St. Lucia County Sheriff, the Police Chiefs of the Cities of Fort Pierce and Port St. Lucia, the State of Florida Department of Low Enforcement and the Florida Highway Patrol, as o result of the effects of Hurricane ~Teann¢, there is a clear and present danger of civil disorder in St. Lucie County and widespread disobedience of the Iow and it is necessary to declare o curfew os hereinafter defined in order to suppress the threat to public peace which now exists and to prevent substantial injury to persons or property. NOW, THEREFORE, l; om issuing the following Order: 1. Effective 5¢ptember~5+~, 2004 al~:~.m., there is o curfew imposed fron~.'~)~.m, to .m. in St. Luci¢ County. burin9 the curfew, all pedestrian end vehicular movement outside homes is prohibited except as provided herein. All persons are commanded to remain in their homes during the hours of curfew unless otherwise directed or authorized by City, County, State of Florida or federal officials. 2. The curfew shall not apply to those persons who need to travel in connection with designated essential services including, but not limited to, emergency personnel, such os ambulance drivers, firefighters, hospital workers including physicians, Iow enforcement officers and utility workers. 3. This Order imposing a curfew shall remain in effect for seven (7} days unless terminated, modified or extended. This Order imposin9 a curfew shall automatically terminate upon a declaration terminating the state of local emergency or upon further Order of the County Administrator or the Board of County Commissioners. This Order imposing a curfew may be modified at any time by subsequent Order of the County Administrator or the Board of County Commissioners. This Order may be extended in not more than seven {7} day increments by subsequent Orders issued by the County Administrator or the Board of County Commissioners. 4. This Order shall, as promptly as practicable, be filed in the office of the Clerk of the Circuit Court and delivered to the appropriate news media for publication and radio and television broadcast thereof.
