WITNESSETH That the grantor, for and in consideration of One ($1.00) Dollar and other good and valuable consideration do(es) hereby give, grant, bargain and release to grantee, its agents, assigns, contractors and sub-contractors, a temporary construction easement to enter upon that portion of certain lands owned by the grantor being described as follows: See attached sketch and legal for the purpose of tying in, restoring and harmonizing said property, with construction of roadway and appurtenant facilities within existing right-of-way. This Easement is granted upon the condition that the sloping and/or grading upon the above land shall not extend beyond the limits outlined above and that all grading or sloping conform to all existing structural improvements within the limits designated, and all work will be performed in such a manner that existing structural improvements will not be damaged and the Grantee shall not unreasonably interfere with or obstruct Grantors ingress and egress to Grantor's property. This Easement shall expire upon the earlier of the completion of the construction of the above referenced road construction project, or one year from the start of construction. The County will remove and immediately replace the fence out of the construction area making sure the cows do not get out of the fenced in area. The County will replace the fence in the same location as it was before construction. The County will not remove or damage the large oak trees that are along the property line. The undersigned hereby covenant and warrant that they own the said land and have the right to grant this easement.
