LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: CONDITIONAL USE PERMIT 1. Armortec Concrete Plant. presented a petition for a Conditional Use Permit to allow for the operation of a concrete block manufacturing facility in the IH (Industrial, Heavy) Zoning District, depicted on the attached maps as Exhibit "A" and described in Part "B" below. 2. On October 28, 2004, the St. Lucie County Planning and Zoning Commission held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners approve a conditional use permit to allow for the operation of a concrete manufacturing facility in the IH (Industrial, Heavy)) Zoning District for the property depicted on the attached Maps and described in Part B below. 3. On December 21, 2004, this Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. 3. The proposed Conditional Use is consistent with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan and has satisfied the requirements of Section 11.07.03 of the St. Lucie County Land Development Code. 4. The proposed Conditional Use will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. The proposed Conditional Use will be serviced by adequate public facilities and services. Section 11.07.05(8) of the St. Lucie County Land Development Code requires that all applications for Conditional Use Permit approval include a full site plan if the proposed use or development activity meets the submission requirements of Section 11.02.02 of the St. Lucie County Land Development Code. SITE PLAN Armortec Concrete Plant, has applied for major site plan approval for the project to be known as Armortec Concrete Plant consisting of 16,296 square feet of space on 3.61 acres of property located at the eastern terminus of Magnum Drive in the IH (Industrial, Heavy) Zoning District for the property described in Part A. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet minimum technical requirements of the St. Lucie County Land Development Code and to be consistent with the future land use maps from the St. Lucie County Comprehensive Plan. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. The proposed project will be served by adequate public facilities and services. The applicant has applied for and received a revised certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, a Conditional Use Permit for Armortec Concrete Plant to allow the operation of a concrete block manufacturing facility to be known as Armortec Concrete Plant in the IH (Industrial, Heavy) Zoning District Permit is hereby granted for the property depicted on the attached maps as Exhibit "A" and described as follows: LOT 5, ACCORDING TO THE PLAT OF MIDWAY INDUSTRIAL PARK PHASE I, AS RECORDED IN PLAT BOOK 38, PAGE 35-35A OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. SAID LAND CONTAINS 3.61 ACRES, MORE OR LESS. (Tax ID#: 3403-502-0344-000/0) (Location: North side of the eastern terminus of Magnum Drive) SITE PLAN B. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the site plan for the project to be known as Armortec Concrete Plant, is hereby approved as shown on the site plan drawings for the project prepared by Gentile, Holloway, Q'Mahoney & Associates, Inc. dated July 29,2004, and date stamped received by the St. Lucie County Growth Management Director on July 29, 2004, for the property depicted on the attached maps as Exhibit "B" and described as follows: LOT 5, ACCORDING TO THE PLAT OF MIDWAY INDUSTRIAL PARK PHASE I, AS RECORDED IN PLAT BOOK 38, PAGE 35-35A OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. SAID LAND CONTAINS 3.61 ACRES, MORE OR LESS. (Tax ID#: 3403-502-0344-000/0) (Location: North side of the eastern terminus of Magnum Drive) C. The approvals and authorizations granted by this Resolution for the purpose of obtaining building permits on this property shall expire on December 21, 2005, unless building permits have been issued or an extension in accordance with Section 11.07.05(F) of the St. Lucie County Land Development Code has been granted. D. The Conditional Use Permit approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, Armortec Concrete Plant, including any successors in interest, shall obtain all necessary permits and authorizations from the appropriate Local, State, and Federal regulatory authorities prior to the issuance of any local building permits or authorizations to commence development activities on the property described in Part B. F. The St. Lucie County Growth Management Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of St. Lucie County, Florida, and to make notation of reference to the date of adoption of this resolution.
