A RESOLUTION DEFINING A CLASS "A' MOBILE HOME AS A
SINGLE-FAMILY DETACHED DWELLING UNIT IN THE AG-5
(AGRICULTURAL - 1 DU/5 ACRES) ZONING DISTRICT
WHEREAS, the Board of County Commissioners of S1. Lucie County, Florida, based on the
testimony and evidence, including but not limited to the staff report, has made the following
determinations:
1. Mark Pve presented a petition to Define a 24-foot by 52-foot General Manufactured
Housing, Inc. Class "A" Mobile Home as a Detached Single-Family Dwelling Unit in the
AG-5 (Agricultural - 1 du/5 acres) Zoning District for the property described below.
2. On April 6, 2004, this Board held a public hearing on the petition, after publishing a
notice of such hearing and notifying by mail all owners of property within 500 feet of
the subject property.
3. The Class "A" Mobile Home determination is consistent with all elements of the S1.
Lucie County Comprehensive Plan and has satisfied the standards of review set forth
in Section 11 .05.02(D) of the S1. Lucie County Land Development Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of S1. Lucie
County, Florida:
A. The S1. Lucie County Board of County Commissioners has determined that the request of
Mark Pye to Define a 24-foot by 52-foot, General Manufactured Housing, Inc., Class "A" Mobile
Home as a Detached Single-Family Dwelling Unit to be located on that property described as
follows:
THE BEING A PARCEL OF LAND LYING IN SECTION 34 AND 35, TOWNSHIP 36 SOUTH,
RANGE 38 EAST, THE BOUNDARY OF WHICH IS MORE PARTICULARLY DESCRIBED AS
FOLLOWS: FROM THE NORTHWEST CORNER OF SAID SECTION 35, RUN SOUTH 0
DEGREES 33'30" EAST ALONG THE SECTION LINE 2219.17 FEET TO THE POINT OF
BEGINNING OF THE PARCEL TO BE HEREIN DESCRIBED; THENCE ENTERING
SECTION 35, RUN NORTH 70 DEGREES 00' EAST 179.79 FEET; THENCE SOUTH 64
DEGREES 25' EAST 282.25 FEET; THENCE SOUTH 62 DEGREES 24' EAST 253.7 FEET;
THENCE SOUTH 81 DEGREES 21' EAST 45.67 FEET TO A POINT ON THE TOP OF A
DIKE; THENCE FOLLOWING SAID DIKE, RUN SOUTH 0 DEGREES 30'20" WEST 718.55
FEET; THENCE SOUTH 30 DEGREES 20'19" WEST 239.78 FEET; THENCE SOUTH 72
DEGREES 41'50" WEST 347.84 FEET; THENCE NORTH 50 DEGREES 26'10" WEST
288.41 FEET TO A POINT ON THE WEST LINE OF SAID SECTION 35; THENCE LEAVING

POINT OF BEGINNING. TOGETHER WITH A NON-EXCLUSIVE EASEMENT FOR INGRESS
AND EGRESS IN, OVER AND ACROSS THE NORTH 60 FEET OF SECTION 34,
TOWNSHIP 36 SOUTH, RANGE 38 EAST; THE INTEREST HEREBY GRANTED TO BE
APPURTENANT TO AND A BENEFIT OF THE LAND HEREINABOVE DESCRIBED.
TOGETHER WITH A NON-EXCLUSIVE EASEMENT FOR INGRESS AND EGRESS AND
FOR DRAINAGE AND IRRIGATION PURPOSES AS IS MORE SPECIFICALLY SET FORTH
IN THAT CERTAIN EASEMENT DATED DEC. 10, 1963 BY AND BETWEEN CIRCLE M.
RANCH, INC. AND BRIAN K. MCCARTY, RECORDED IN OR BOOK 77, PAGE 377, OF THE
PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA, SAID EASEMENT RIGHT AND
INTEREST TO BE APPURTENANT TO THE SAID LANDS HEREINABOVE DESCRIBED.
TOGETHER WITH A NON-EXCLUSIVE EASEMENT FOR DRAINAGE PURPOSES OVER
THE WEST 50 FEET OF SECTION 26, TOWNSHIP 36 SOUTH, RANGE 38 EAST, ST. LUCIE
COUNTY, FLORIDA, AS SHOWN IN OR BOOK 395, PAGE 1831, OF THE PUBLIC
RECORDS OF ST. LUCIE COUNTY, FLORIDA, SAID EASEMENT RIGHT AND INTEREST
TO BE APPURTENANT TO THE SAID LANDS HEREINABOVE DESCRIBED. TOGETHER
WITH AN EASEMENT FOR DRAINAGE AND INGRESS AND EGRESS OVER AND ACROSS
THE WESTERLY 50 FEET OF PARCEL 1 DESCRIBED IN OR BOOK 274, PAGE 2646, AND
THE WESTERLY 50 FEET OF THE NORTHERLY 213.28 FEET OF PARCEL 2 DESCRIBED
IN OR BOOK 274, PAGE 2646, AS SAID 50 FOOT DRAINAGE AND ACCESS EASEMENT IS
SHOWN ON SURVEY DATED AUGUST 30, 1977, PREPARED BY S.P. MUSICK,
REGISTERED LAND SURVEYOR, FLORIDA CERTIFICATE # 1192. TOGETHER WITH A
RIGHT-OF-WAY AND EASEMENT TO UTILIZE THE PERIMETER CANALS OF PARCEL 1
RECITED IN OR BOOK 395, PAGE 1831, OF THE PUBLIC RECORDS OF ST. LUCIE
COUNTY, FLORIDA, FOR DRAINAGE AND IRRIGATION PURPOSES. (TAX ID#: 3234-144-

is consistent with the requirements of Section 11.05.02(0) of the St. Lucie County Land
Development Code, and is hereby approved. The General Location Map and Area Subject to the
Class "A" Mobile Home Permit are attached as Exhibit "A".
B. A copy of this resolution shall be placed on file with the St. Lucie County Community
Development Director.
