A RESOLUTION GRANTING A MAJOR ADJUSTMENT TO THE EXISTING
CONDITIONAL USE FOR THE PROJECT KNOWN AS TARMAC
AMERICA, LLC
WHEREAS, the Board of County Comrnissioners of St. Lucie County, Florida, based on the
testimony and evidence, including, but not lirnited to the staff report, has made the following
determinations:
1. Tarmac America, LLC., has applied for a major adjustment to their existing conditional
use perrnit to allow the expansion of their concrete manufacturing activities.
2. On February 15, 2005, this Board held a public hearing on the petition, after publishing a
notice of such hearing and notifying by mail all owners of property within 500 feet of the
subject property.
3. The proposed Major Adjustment to an Existing Conditional Use is consistent with the
goals, objectives, and policies of the St. Lucie County Comprehensive Plan and has
satisfied the requirernents of Section 11.07.03 of the St. Lucie County Land
Development Code.
4. The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other matters
affecting the public health, safety, and general welfare.
5. The proposed project will be serviced by adequate public facilities and services.
6. A Certificate of Capacity, a copy of which is attached to this resolution, was granted by
the Growth Management Director on February 15, 2005.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
A. Pursuant to Section 11.07.05(E), of the St. Lucie County Land Development Code, the
Major Adjustment to the Existing Conditional Use for Tarmac America, LLC., is hereby approved
for the property described below, subject to the following conditions:
1. The applicant shall provide documentation from the Florida Department of
Environmental Protection and the Army Corps of Engineers regarding the
verification of surveyed wetland limits upon receipt.

2. All gopher tortoises located within the limits of construction impacts shall be
relocated (with an approved Florida Fresh Water Conservation Commission
permit) to the on-site gopher tortoise preserve area prior to the approval of a
Vegetation Removal Permit.
3. The applicant shall preserve areas to be used for 1) gopher tortoise preserve, 2)
tree mitigation, and 3) landscaping, in perpetuity. The applicant shall provide a
conservation easement in a form acceptable by St. Lucie County for these areas.
B. The property on which this Major Adjustment is being approved is described as follows:

NORTH OF THE SOUTHEAST CORNER OF THE NORTHEAST 1/4 OF SECTION 31 RUN

2,415.59 FEET TO THE EAST RIGHT -OF-WAY LINE OF CANAL #99,THENCE, NORTHERLY
ALONG THE EAST RIGHT -OF-WAY LINE 193.84 FEET TO THE SOUTHEASTERLY RIGHT-
OF-WAY LINE OF THE FLORIDA EAST COASTC RAILROAD,THENCE NORTH 44°42'45"
EAST ALONG RAILROAD RIGHT -OF-WAY LINE 1,755.17 FEET ,THENCE SOUTH 00°01 '09"
EAST 1,381.25 FEET, THENCE NORTH 89°58' 51" EAST 1,310.44 FEET TO THE WEST
RIGHT-OF-WAY LINE OF SELVITZ ROAD,THENCE SOUTH 00°02'51" WEST 60 FEET TO

C. The approval granted under this Major Adjustment to an Existing Conditional Use
approval shall expire on February 15, 2006, unless a building permit is issued or an extension is
granted in accordance with Section 11.07.05(F) of the St. Lucie County Land Development
Code.
D. A Certificate of Capacity, a copy of which is attached to this resolution, was granted by
the Growth Managernent Director on February 15, 2005, shall remain valid for the period of
Conditional Use approval. Should the Conditional Use approval granted by this resolution expire
or an extension be sought pursuant to Section 11.07.05(F) of the St. Lucie County Land
Development Code, a new certificate of capacity shall be required.
E. The Conditional Use Permit approval granted under this Resolution is specifically
conditioned to the requirement that the petitioner, Tarmac America, LLC, including any
successors in interest, shall obtain all necessary developrnent perrnits and construction
authorizations from the appropriate State and Federal regulatory authorities, including but not
limited to; the Federal Aviation Adrninistration, St. Lucie County International Airport, United
States Arrny Corps of Engineers, the Florida Department of Environmental Protection, and the
South Florida Water Management District, prior to the issuance of any local building permits or
authorizations to commence development activities on the property described in Part A.

cause the notation of this resolution to be made on the Official Zoning Map of St. Lucie County,
Florida, and to make notation of reference to the date of adoption of this resolution.
