AN ORDER GRANTING A VARIANCE FROM SECTION 6.02.02(B)(2)(a), ST. LUCIE
COUNTY LAND DEVELOPMENT CODE - NORTH FORK OF THE ST. LUCIE RIVER
SHORELINE SET BACK REQUIREMENTS FOR CRISTANO GAMBOA
WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for a
Variance from Section 6.02.02(B)(2)(a) and made the following determinations:
1. Cristano Gamboa, presented a petition for a variance from the provisions of Section
6.02.02(B)(2)(a), St. Lucie County Land Development Code for the purpose of building a
single family residence in the project known as Riverdale Yacht Club Estates in St. Lucie
County, Florida. The subject property is located on Lots 6 and 7, Merry Bee Drive in Port St.
Lucie, Florida.
2. On April 29, 2005, the Growth Management Director and the Environmental Resources
Manager reviewed the application requesting a variance from Section 6.02.02(B)(2)(a), St.
Lucie County Land Development Code to permit the development of one single-family
residence that lacks a maximum of 9 feet of the minimum 50 foot rear setback from the
mean high water line for lots of record platted after August 1, 1989, which are located along
the North Fork of the St. Lucie River.
3. After consideration of the application presented, including staff comments and the standards
of review for granting variances set out in Section 10.01.30, St. Lucie County Land
Development Code, the Growth Management Director has made the following
determinations:
1. The requested variance meets the standards of review as set forth in Section
10.01.30 of the Sl Lucie County Land Development Code and is not in conflict
with the goals, objectives, and policies of the Sl Lucie County Comprehensive
Plan.
2. The requested variance is necessary to reduce impacts to wetlands found on-
site.
3. Granting of this variance to allow for a 41 foot buffer will not adversely affect
the native vegetation on-site.

NOW, THEREFORE, BE IT ORDERED:
A. The petition for a Variance of 9 feet from the provisions of Section 6.02.02(8)(2)(a), St. Lucie
County Land Development Code, North Fork of the St. Lucie River shoreline setback
standards, submitted by Cristano Gamboa for the purpose of building a single family
residence in the Riverdale Yacht Club Estates project, is granted for the property described
below.
RIVERDALE YAHT CLUB ESTATES, UNIT 2, BLOCK 12, LOTS SIX AND SEVEN (OR 1902-75)
CONTAINING: 0.42, MORE OR LESS.
(Location:
West side of Merry Bee Drive east of the North Fork of the St. Lucie River)
8. This variance shall not be valid for a period longer than twelve months from the date of this
Resolution - May 15, 2005 - unless a building permit or other applicable local site
development permit effecting the restoration of the effected shoreline area is issued prior to
the expiration of that twelve month period.
C. This Order shall become effective upon the date of approval indicated below. Should the
property owner, developer, or authorized agent wish to appeal any condition described in
Section A above, all such appeals must be filed in writing with the County Administrator
within 30 days ofthe rendering of this Order, as described in Section 11.02.03(8), St. Lucie
County Land Development Code. Should an appeal to this Order be filed, no permitting
reviews or further administrative action shall take place on the processing of this
development project until the appeal is resolved.
D. This Order shall be recorded in the Public Records of St. Lucie County.
ORDER effective the 15th day of May 2005.
