FLit- P~.~- 1 2 3 4 RESOLUTION 05-150 FILE NO.: MJSP-05-002 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 A RESOLUTION GRANTING MAJOR SITE PLAN APPROVAL FOR THE PROJECT TO BE KNOWN AS CAPRON TRAIL PARK - LAKEWOOD PARK WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: 1 . St. Lucie County Parks and Recreation Department. has applied for major site plan approval for the project to be known as Capron Trail Park - Lakewood Park consisting of a Community Park to include: Aquatic Complex, (4) Soccer Fields, (4) Baseball Fields, (6) Shelters, Restroom/Concession Building (2-story), Maintenance Building, Multi purpose Paths, Walkways, Asphalt Parking Lots, Grass Overflow Parking, Water Treatment System, Lift Stations and Playground for property located on the east side of Emerson Ave and north of Waterstone FKA Emerson Estates Planned Unit Development and 1.5 miles north of Indrio Road in the I (Institutional) Zoning District for the property described in Part B. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet minimum technical requirements of the St. Lucie County Land Development Code and to be consistent with the future land use maps from the St. Lucie County Comprehensive Plan. 3. The proposed project is consistent with the general purpose, goals, objectives, and standards of review of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 4. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 6. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The proposed project will be served by adequate public facilities and services. 8. The applicant has applied for and received a certificate of capacity exemption, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the site plan for the project known as Capron Trail Park - Lakewood Park, is hereby approved as shown on the site plan drawings for the project prepared by Robert Walters Architects, dated, February 15, 2005, and revised date April 10, 2005, for the property described below, subject to the following condition: All maintenance for Capron Trail Park will be the responsibility of St. Lucie County Parks and Recreation Department. B. The property on which this Major Site Plan is being granted is described as follows: PARCEL ONE: THE NORTH % OF THE NORTHWEST Y4 SECTION 11, TOWNSHIP 34 SOUTH, RANGE 39 EAST, IN ST. LUCIE COUNTY, FLORIDA; LESS AND EXCEPT THE NORTH 33 FEET OF THE NORTHWEST Y4 OF THE NORTHWEST Y4 OF SAID SECTION, SUBJECT TO THE EFFECT OF ANY DEDICATIONS FOR CANAL AND FOR EMERSON AVENUE ON THE WEST SIDE OF THE ABOVE DESCRIBED PROPERTY AND ANY DEDICATIONS FOR THE CANAL ON THE EAST SIDE OF THE ABOVE DESCRIBED PROPERTY, LESS AND EXCEPT PROPERTY CONVEYED TO THE STATE OF FLORIDA IN DEED BOOK 262, PAGE 634 MORE PARTICULARY DESCRIBED AS FOLLOWS: THE EAST 35 FEET OF THE WEST 95 FEET OF THE NORTH % OF THE NORTH WEST Y4 SECTION 11, TOWNSHIP 34 SOUTH, RANGE 39 EAST, LESS THE NORTH 33 FEET OF THE NORTHWEST Y4 OF THE NORTHWEST Y4 OF SAID SECTION. PARCEL TWO: THE SOUTH % OF THE NORTHWEST % SECTION 11, TOWNSHIP 34 SOUTH, RANGE 39 EAST IN ST. LUCIE COUNTY, FLORIDA; LESS AND EXCEPT THE EAST 35 FEET OF THE WEST 95 FEET AND LESS RIGHT-OF WAYS FOR ROAD AND DRAINAGE CANAL. The approvals and authorizations granted by this Resolution for the purpose of obtaining building permits on this property, shall expire on September 13, 2007, unless the developer has obtained building permits for the site plan described in Part A or an extension has been granted in accordance with Section 11 .02.06, St. Lucie County Land Development Code. D. The Final Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioner, St. Lucie County Parks and Recreation Department, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities, including but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. E. A copy of this resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Director. The certificate of capacity exemption, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the certificate of capacity exemption shall automatically terminate. G. A copy of this Order shall be mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. H. This Order shall be recorded in the Public Records of St. Lucie County.
