Lucie County Growth Management Director has reviewed the application for site plan approval submitted by Perry Martin for Midway Ranches, LLC, reviewed the comments of the S1. Lucie County Development Review Committee on this application, and made the following determinations: 1. A 7 lot residential subdivision has been proposed for a project to be known as Midway Ranches, in the Agricultural (AG-5 -1 du/5ac) Zoning District for the property described in Part A and generally located one mile south of West Midway Road on the west side of Shinn Road, Fort Pierce, Florida. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be consistent with the S1. Lucie County Comprehensive Plan. 3. The proposed project is consistent with the general purpose, goals, objectives, and standards of the S1. Lucie County Comprehensive Plan and the S1. Lucie County Land Development Code. 4. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 6. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The proposed project is to be served by an on-site well and an onsite septic system. 8. The applicant has applied for and received a Certificate of Capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, S1. Lucie County Land Development Code. Pursuant to Section 11.02.03(A)(5) of the St. Lucie County Land Development Code, the Final Site Plan for the project to be known as Midway Ranches be, and the same is hereby, approved as shown on the site plan drawings for the project prepared by The Velcon Group, Inc., on January 20,2005 and last revised on September 9,2005 and date stamped received by the St. Lucie County Growth Management Director on September 15, 2005, subject to the following conditions: 1. As part of, the final platting of the subject property, the developers shall be required to convey to St. Lucie County, in manner and form acceptable to the St. Lucie County Attorney, 30 feet of additional right-of-way along the site plans eastern property line for the future widening of Shinn Road and 36.5 feet of additional right- of-way along the site plans western property line for the future widening of Wolf Road. To the extent permitted under the County's Code and Compiled Laws, any such dedication may be considered eligible for Road Impact Fee Credits. 2. Prior to scheduling this plan for final plat approval, the applicant, developers, or assigns shall make payment of the fair share contribution for the paving of Shinn Road and provide an executed escrow agreement. The County Engineer shall review and approve the developers cost estimate for the fair share allocation for the paving of Shinn Road. 3. The County Engineer shall determine whether a driveway permit or right of way permit is necessary for the connection to Shinn Road. B. The property on which this site plan approval is being granted is described below: THE SOUTH ONE-HALF OF THE NORTH ONE-HALF OF THE SOUTHWEST ONE-QUARTER AND THE NORTH ONE-HALF OF THE SOUTH ONE-HALF OF THE SOUTHWEST QUARTER OF SECTION 7, TOWNSHIP 36 SOUTH, RANGE 39 EAST, ST. LUCIE COUNTY, FLROIDA LESS THE EAST 50 FEET AND THE WEST 43.5 FEET THEREOF. Location: 6099 Shinn Road, approximately one and one-half (1.5) miles south of West Midway Road Parcel Identification Number: 3307-313-0000-0002 C. This site plan shall expire on October 3, 2007, unless a building permit or a site plan approval extension is granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. All requests for site plan extension shall be accompanied by a request for a new certificate of capacity for the property and project described in this Order. D. The Final Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioner, Perry Martin for P.M. Midway Realty III LLC and Midway Ranches LLC, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to; the United States Army Corps of Engineers, the October 4, 2005 Page 2 GM Order 05-025 Midway Ranches 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property. E. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Section A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.03(8), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. F. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. G. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the certificate of capacity shall automatically terminate. H. This order shall be recorded in the Public Records of St. Lucie County.
