LUCIE COUNTY, FLORIDA, STATING ITS INTENT TO USE THE UNIFORM METHOD OF COLLECTING NON-AD VALOREM SPECIAL ASSESSMENTS LEVIED BY THE PROPOSED ATLANTIC BEACH BOULEVARD MUNICIPAL SERVICES BENEFIT UNIT; DESCRIBING THE AREA SUBJECT TO THE ASSESSMENT; STATING A NEED FOR THE LEVY; PROVIDING FOR MAILING THE RESOLUTION; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Board of County Commjssjoners of St. Lucje County, Florida (the "Board") js contemplating the creatjon of the Atlantjc Beach Boulevard Munjcjpal Servjces Benefjt Unit (the "MSBU") to fund the cost of a project to provjde wastewater jmprovements to propertjes wjthjn the boundarjes of the proposed Atlantic Beach Boulevard MSBU (the "Project") in St. Lucje County; and WHEREAS, the Board, as the governing body of the MSBU, intends to use the uniform method for collecting non-ad valorem special assessments to fund the cost of the Project as authorjzed by Sectjon 197.3632, Florjda Statutes because thjs method wjll allow the specjal assessments to be collected annually commencjng jn November 2006, in the same manner as provjded for ad valorem taxes; and WHEREAS, on December 13, 2005, the Board held a duly advertjsed publjc hearing to consjder the adoption of this resolution, proof of publjcatjon of thjs hearjng js attached hereto and made a part hereof as Exhjbjt "A". 1 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commjssjoners of St. Lucje County, Florida, as follows: Section 1: Commencing wjth the 2006-2007 Fjscal Year and wjth the tax statement majled for the 2006-2007 Fjscal Year, the Board intends to use the uniform method of collectjng non-ad valorem assessments authorjzed jn Section 197.3632, Florjda Statutes for collectjng non-ad valorem assessments levjed by the proposed Atlantjc Beach Boulevard MSBU to fund the cost of a project to provide wastewater jmprovements to properties wjthjn the boundarjes of the proposed Atlantic Beach Boulevard MSBU. A descrjptjon of the boundaries of the real property wjthin the proposed MSBU and subject to the levy is attached hereto and made a part hereof as Exhjbjt "B". Section 2: The Board hereby determines that the levy of the assessments are necessary to fund the cost of the Project. Section 3: Upon adopt jon, the County Attorney is hereby directed to send a copy of thjs resolutjon by Unjted States majl to the Florjda Department of Revenue, and the St. Lucje County Property Apprajser and Tax Collector. Section 4.
