FRY, Jr., CLERK OF THE CIRCUIT COURT SAINT LUCIE COUNTY FILE # 281927903/23/2006 at 09:13 AM OR BOOK 2515 PAGE 2892 - 2894 Doc Type: RESO RECORDING: $27,00 A RESOLUTION PROVIDING FOR A 12-MONTH EXTENSION OF FINAL PLANNED UNIT DEVELOPMENT APPROV AL OF THE PROJECT KNOWN AS W ATERSTONE - PUD F/K/A EMERSON ESTATES - PUD WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. On December 2, 2003, this Board, through Resolution No. 03-240, granted Final Planned Unit Development approval for the project known as Emerson Estates - PUD, a proposed 720 unit project consisting of 544 Single-Family lots and 176 Multiple-Family Units on 240 acres of property located on the east side of Emerson Avenue, approximately 1,000 feet north of Indrio Road. 2. The developer of Waterstone - PUD F /K/ A Emerson Estates - PUD has requested that the Final Planned Unit Development granted through Resolution No. 03-240, be extended for a period of 12 additional months from its date of scheduled expiration, November 25, 2005. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.06(B)(2) of the St. Lucie County Land Development Code, the Final Planned Unit Development, approved through Resolution No. 03-240 is hereby extended for a period of 12 additional months from its date of scheduled expiration, December 2, 2005, with the new expiration date being December 2, 2006, subject to compliance with the following conditions as determined by the Board: 1. The previously approved construction work days and hours of Monday through Friday (7:00 a.m. to 5:30 p.m.) and Saturday (7:00 a.m. to 1:00 p.m.) shall be strictly enforced. The developer shall not work on approved national holidays. Violation of this condition shall result in a fine of $1,500.00 per violation. 2. developer shall: Within thirty (30) days from the date of adoption of this Resolution, the a. Replace the trees on the Stewart's property that were destroyed by clearing; b. Repair the Stewart's pasture fence; c. Remove the fence debris from the hurricane from the Stewart's pasture; fence. d. Backfill the berm to eliminate the gaps between the berm and the 3. Within sixty (60) days from the date of adoption of this Resolution; the developer shall fix the outfall used by the Stewarts. 4. At the recordation of the plat for Phase II, the developer shall pay a proportionate share as determined by the Board of the cost to improve the intersection of Indrio Road and Emerson Avenue based on a design approved by the County Engineer. TOGETHER WITH: PARCEL 2: THE SW 1/4 OF SECTION 11, TOWNSHIP 34 SOUTH, RANGE 39 EAST, ST. LUCIE COUNTY, FLORIDA, LESS AND EXCEPT THE EAST 80 FEET AND THE WEST 95 FEET THEREOF FOR ROAD AND CANAL RIGHTS OF WAY. TOGETHER WITH: PARCEL 3: THE SOUTH 50 ACRES OF THE NORTH t OF THE NW 1/4 OF SECTION 14, TOWNSHIP 34 SOUTH, RANGE 39 EAST, ST. LUCIE COUNTY, FLORIDA, LESS AND EXCEPT THE EAST 80 FEET AND THE WEST 95 FEET THEREOF FOR ROAD AND CANAL RIGHTS OF WAY. CONTAINS 10,020,849 SQUARE FEET OR 230.047 ACRES, MORE OR LESS. TOGETHER WITH: THE N t OF THE N t OF THE SW 1/4 OF THE NW 1/4 AND THE N t OF THE N t OF THE SE 1/4 OF THE NW 1/4 AND THE S t OF THE NW 1/4 OF THE SW 1/ OF THE NW 1/4 OF SECTION 14, TOWNSHIP 34 SOUTH, RANGE 39 EAST; SAID LAND LYING AND BEING IN ST. CONTAINS 10.020 ACRES, MORE OR LESS. CONTAINS 240.067 ACRES, MORE OR LESS. (Location: East side of Emerson Avenue, approximately 1,000 feet north of Indrio RoadO D. This Final Planned Unit Development Plan extension shall expire on December 2,2006, unless Final Plat Approval is obtained in accordance with Section 11.03.00 of the St. Lucie County Land Development Code for the site plan or an extension has been granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. E. The Certificate of Capacity granted by the Community Development Director shall remain valid until December 2, 2006. F. The St. Lucie County Growth Management Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of St. Lucie County, Florida, and to make notation of reference to the date of adoption of this resolution. G. A copy of this resolution shall be placed on file with the St. Lucie County Growth management Director.
