HomeMy WebLinkAbout05-143 " 1 RESOLUTION 05-143 2 File Number: PUD-04-018 and RZ-04-031 3 4 A RESOLUTION GRANTING PRELIMINARY 5 DEVELOPMENT PLAN APPROVAL FOR A 6 PROJECT KNOWN AS FRONTERA 7 8 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the 9 testimony and evidence, including but not limited to the staff report, has made the following 10 determinations: 11 12 1. Home Dynamics Corporation presented a petition for a Preliminary Planned Unit 13 Development Approval for a 3I8-unit residential subdivision (146 single-family units, 14 184 townhouse units) to be known as Frontera - PUD. 15 16 2. On May 11, 2005, the St. Lucie County Planning and Zoning Commission held a 17 public hearing on the petition of Home Dynamics Corporation, after publishing a 18 notice of such hearing in the Fort Pierce Tribune and notifying by mail all property 19 owners within 500 feet of the property boundaries. 20 21 3. On June 7, 2005, this Board held a public hearing on the petition of Home Dynamics 22 Corporation, for Preliminary Planned Unit Development approval for the project 23 known as Frontera - PUD after publishing a notice of such hearing in the Tribune 24 and notifying by mail all property owners within 500 feet of the subject property. 25 26 4. The Development Review Committee has reviewed the Preliminary Planned Unit 27 Development site plan for the proposed project and found it to meet all technical 28 requirements and to be consistent with the future land use maps of the St. Lucie 29 County Comprehensive Plan, subject to the conditions set forth in Part A of this 30 Resolution. 31 32 5. The proposed project is consistent with the general purpose, goals, objectives and 33 standards of the St. Lucie County Land Development Code, the St. Lucie County 34 Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 35 36 6. The proposed project will not have an undue adverse effect on adjacent property, the 37 character of the neighborhood, traffic conditions, parking, utility facilities or other 38 matters affecting the public health, safety and general welfare. 39 40 7. All reasonable steps have been taken to minimize any adverse effect of the proposed 41 project on the immediate vicinity through building design, site design, landscaping 42 and screening. 43 June 7,2005 Page 1 EDWIN M. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 9. The proposed project will be served by adequate public facilities and services. 10. The applicant has demonstrated that water supply; evacuation facilities and emergency access are satisfactory to provide adequate fire protection. 11. A Concurrencv Deferral Affidavit, a copy of which is attached to this Resolution, was signed by the applicant on May 24, 2004. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.05(B) of the St. Lucie County Land Development Code, the Preliminary Planned Unit Development Plan for the project to be known as Frontera - PUD, and is hereby, approved as shown on the site plan drawings for the project prepared by Thomas Lucido & Associates, P.A. Group, and date stamped received by the St. Lucie County Growth Management Department on April 26, 2005, subject to the following conditions: 1. Preliminary Development Plan Approval is approved subject to the Florida Department of Communities Affairs issuance of a Notice of Intent to find in compliance St. Lucie County's adoption of Ordinance 05-018 adopting a future land use change for the lands described below. 2. The developer, or his assigns, shall be required to construct left and right turn lanes at the projects Edwards Road entrance and a right turn lane into the project entrance on South 25t Street. 3. Prior to recording of the plat for any portion of the property, the developer, or his assigns, shall have completed the execution of a final utility service agreement with Ft. Pierce Utility Authority, indicating all developer obligations, including schedules associated with servicing this site. 4. Prior to recording of the plat for any portion of the property, the developer, or his assigns, shall submit a letter from the St. Lucie County School Board indicating that they have satisfied the S1. Lucie County School Board. 5. Prior to any Final PUD approval for this project, a professional archaeologist shall conduct an archaeological resource survey and a report of the survey results approved by the Growth Management Department. No Final Plat will be approved until the applicant provides documentation fTom the St. 3 Lucie County Fire District indicating the applicant has satisfied the District requirements 4 set forth in Fire District Resolution No. 420-04. 5 6 7 B. The Preliminary Planned Unit Development Site Plan/General Site Plan approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, Home Dvnamics Corporation, including any successors in interest, shall obtain all necessary development permits and construction authorizations form the appropriate State and Federal regulatory authorities, including but not limited to; the United Stated Army Corp of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. The conditions set forth in Part A are an integral nonseverable part of the site plan approval granted by this Resolution. If any condition set forth in Section A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this resolution shall become null and void. A copy of this Resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Department.
