LUCIE COUNTY, FLORIDA, CLOSING, VACATING AND ABANDONING ANY INTEREST OF ST. LUCIE COUNTY AND THE GENERAL PUBLIC IN ALL THAT PART OF ROAD RIGHT-OF-WAY DESIGNATED AS A PORTION OF AVENUE C WEST OF ANGLE ROAD ACCORDING TO THE PLATOF:HOMEACRESUNIT 2 AS RECORDED INPLATBOOK7 AT PAGE 28, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: Sections 177.101, 336.09 and 336.10, Florida Statutes, as amended, and Section 11.10.01 et. seq. of the St. Lucie County Land Development Code, provide that the County may adopt resolutions vacating rights-of-way in whole or in part, which are under the jurisdiction of the Board of County Commissioners of St. Lucie County, Florida. Pursuant to Plat Book 7, Page 28, St. Lucie County and the general public have a dedicated interest in the following described land: THAT PORTION OF AVENUE C OF HOME ACRES UNIT 2 RECORDED IN PLAT BOOK 7, PAGE 28 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA, LYING WEST OF ANGLE ROAD (STATE ROAD 607A). 3. All relevant public utilities have given written consent for the abandonment. Bell South requested a ten (I 0) foot easement from Hughes, Inc. The easement will be recorded by petitioner upon the vacating of the right-of-way. 6. On March 2, 2004, the Board of County Commissioners approved Permission to Advertise for a Public Hearing on April 6, 2004. 7. On March 12, 2004, letters were mailed to all property owners lying within 300 feet of proposed abandonment area and no objections were filed. Hughes, Inc. will grant a quit-claim deed for one half (1/;¡) of the vacated right-of-way along Ft. Pierce Acquisition's property that abuts Hughes, Inc. property. The petitioner will also record, a quit-claim deed for one-half (1/;¡) of the vacated right-of-way along Carlos Alonso's property, along with an ingress/egress easement along the north property line of Hughes, Inc. 8. On March 19, 2004, a Notice of Public Hearing was advertised in the Ft. Pierce Tribune. 9. At the April 6, 2004, Public Hearing, the Board determined that it is in the best interest of the public to vacate and abandon the right-of-way more particularly described as follows: THAT PORTION OF A VENUE C OF HOME ACRES UNIT 2 RECORDED IN PLAT BOOK 7, PAGE 28 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA, LYING WEST OF ANGLE ROAD (STATE ROAD 607A).
