LUCIE COUNTY, FLORIDA, CLOSING, VACATING AND ABANDONING ANY INTEREST OF ST. LUCIE COUNTY AND THE GENERAL PUBLIC IN TWO UNOPENED, UNNAMED RIGHTS-OF-WAY LYING IN SECTION 4, TOWNSHIP 36 SOUTH, RANGE 40 EAST, ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: That Sections 177.101, 336.09 and 336.10, Florida Statutes, as amended, and Section 11.10.01 et. seq. of the St. Lucie County Land Development Code, provide that the County may adopt resolutions vacating rights-of-way in whole or in part, which are under the jurisdiction of the Board of County Commissioners of St. Lucie County, Florida. Pursuant to Plat Book 1, Page 21, and Plat Book 1 Page 201 St. Lucie County and the general public have a dedicated interest in the following described land: THAT PORTION OF RIGHT-OF-WAY LYING NORTH OF AND CONTIGUOUS WITH (BEING 40 FEET Xl 00 FEET) TOGETHER WITH: THAT PORTION OF RIGHT-OF-WAY LYING SOUTH OF AND CONTIGUOUS WITH (BEING 20 FEET X 100 FEET) LOTS 1 & 2, BLOCK 51 OF WHITE CITY SUBDIVISION, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 1 AT PAGE 21, ALSO RECORDED IN PLAT BOOK 1 AT PAGE 201, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA CONTAINING 6000 Sq. FEET, MORE OR LESS. 1 3. The abandonment 0 f t he two unopened, unnamed rights-of-way will permit Buccaneer Development, Inc. the most efficient utilization of the Petitioner's property. 4. A Notice of Intent to Abandon was advertised on October 29, 2004 and November 14, 2004 and no objections were filed. 5. All relevant public utilities have given written consent for the abandonment. 6. County Department staff members have reviewed the petition and have filed no objections to the proposed abandonment contingent on Buccaneer Development, Inc. dedicating right-of-way on Sunrise Blvd. 7. All abutting property owners have been notified and no objections have been filed. 8. On February 8, 2005, the Board of County Commissioners approved Permission to Advertise for a Public Hearing on March 1, 2005. 9. On February 14, 2005, a Notice of Public Hearing was advertised in the Fort Pierce Tribune. 10. It is in the best interest of the public to vacate and abandon the right-of-way more particularly described as follows: THAT PORTION OF RIGHT-OF-WAY LYING NORTH OF AND CONTIGUOUS WITH (BEING 40 FEET X 100 FEET) TOGETHER WITH: THAT PORTION OF RIGHT-OF-WAY LYING SOUTH OF AND CONTIGUOUS WITH (BEING 20 FEET X 100 FEET) LOTS 1 & 2, BLOCK 51 OF WHITE CITY SUBDIVISION, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 1 AT PAGE 21, ALSO RECORDED IN PLAT BOOK 1 AT PAGE 201, OF THE PUBLIC RECORDS OF ST.
