RESOLUTION NO. 06-183
A RESOLUTION AMENDING THE ST. LUCIE COUNTY
MANUAL OF PURCHASING REGULATIONS BY AMENDING
SECTION 9.7 OF THE PURCHASING MANUAL TO
INCREASE THE AMOUNT TO $100,000.00 THAT A
CONTRACT MUST NOT EXCEED TO BE WAIVED FROM THE
REQUIREMENT OF A PUBLIC CONSTRUCTION BOND IN
ACCORDANCE WITH SECTION 255 . 05, FLORIDA
STATUTES; AMENDING SECTION 9.7 TO ALLOW COUNTY
ADMINISTRATOR TO REVIEW REQUESTS FOR WAIVER OF
BOND REQUIREMENTS FOR CONTRACTS BETWEEN
$100,000 AND $200,000; PROVIDING EFFECTIVE
DATE.
WHEREAS, the Board of County Commissioners of St. Lucie County,
Florida, has made the following determinations:
1. On October 7, 1985, the Board of County Commissioners for
St. Lucie County, (the "Board") adopted Resolution No. 85-212 which
established the purchasing regulations and procedures for St. Lucie
County, Florida, as set forth in the St. Lucie County Manual of
Purchasing Regulations and Procedures (the "Purchasing Manual") ; and
since that date the Purchasing Manual has been amended from time to
time, most recently by Resolution No. 04-189.
2. Section 255.05, Florida Statutes, waives the payment and
performance bonding requirements for State contracts which do not
exceed $100,000.
3. The current Purchasing Manual waives the payment and
performance bonding requirements for County contracts which do not
exceed $50,000.
4. The current purchasing manual allows the County
Administrator to review requests for waiver of the bond requirements
for contracts between $50,000 and $200,000.
5. In order to provide more efficient and expeditious
purchasing procedures, it is necessary to amend the Purchasing
Manual to increase the threshold for waiver of payment and
performance bonding requirements to $100,000.00 and to allow the
County Administrator to review requests for waiver of the bond
requirements for contracts between $100,000 and $200,000.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of St. Lucie County, Florida:
1. The St. Lucie County Manual of Purchasing Regulations and
Procedures is hereby amended as shown in the attached Exhibits "A".
2. This resolution shall become effective upon adoption.

PURCHASING MANUAL
EFFECTIVE DATE: June 6. 2006
SECTION 9 - CONSTRUCTION CONTRACTS
9.7 BONDING AND INSURANCE REQUIREMENTS
a. Public Construction Bond
Section 255.05, Florida Statutes, provides that any person
entering into a formal contract with the Board of County
Commissioners for the construction or repair of any public
building or public work shall be required to execute the usual
Penal Bond with good and sufficient sureties. Section 255.05,
Florida Statues, further provides that the Board of County
Commissioners, in its discretion, may exempt any person
entering into a contract that is for $200,000.00 or less from
executing the usual penal bonds for construction and repair on
public buildings and public work. The Board has determined
not to require a public construction bond for projects under
~SB.OOO.OO $100.000.00 unless deemed necessary by the
Requesting Department or Purchasing Department. Request for
waiver of the bond requirements between ~:JO,OOO.OO $100,000.00
and $200,000.00 shall be reviewed and approved by the County
Administrator on a case-by-case basis.
