AN ORDER GRANTING APPROVAL FOR A
MINOR SITE PLAN TO BE KNOWN AS
HOWARD CREEK ESTATES SID
WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for site
plan approval submitted by Anthony Nardone, reviewed the comments of the St. Lucie County
Development Review Committee on this application, and made the following determinations:
1. Howard Creek Estates SID, is a proposed 5-lot subdivision for property located on the
northwest corner of the intersection of Howard Creek Lane and Everglades Boulevard in the
RS-4 (Residential, Single- Family - 4 du/acre) Zoning District.
2. The Development Review Committee has reviewed the site plan for the proposed project
and found it to meet technical requirements of the Land Development Code and to be
consistent with the St. Lucie County Comprehensive Plan.
3. The proposed project is consistent with the general purpose, goals, objectives, and
standards of the St. Lucie County Land Development Code, the St. Lucie County
Comprehensive Plan, and the Code of Ordinances of St. Lucie County.
4. The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other matters
affecting the public health, safety, and general welfare.
5. All reasonable steps have been taken to minimize any adverse effect of the proposed project
on the immediate vicinity through building design, site design, landscaping, and screening.
6. The proposed project will be constructed, arranged, and operated so as not to interfere with
the development and use of neighboring property, in accordance with applicable district
regulations.
7. The proposed project will be served by adequate public facilities and services.
NOW, THEREFORE, BE IT ORDERED:
A. Pursuant to Section 11.02.03 (D) of the St. Lucie County Land Development Code, the
proposed Minor Site Plan to be known as Howard Creek Estates SID, is hereby approved
as shown on the site plan drawings for the project prepared by, dated November 1, 2004,
and received by the SI. Lucie County Growth Management Director on November 2, 2004,

and the preliminary plat received by the Growth Management Director on February 25, 2006,
on the property described below, subject to the following conditions:
1. Prior to issuance of a building permit, the developer, his successors or
assigns, shall be required to apply to the Army Corps of Engineers for a
wetland boundary determination and permission to impact any wetland on site
with any required mitigation. This information need to be clearly conveyed to
those future purchasers of the lots with wetlands on them (through deed or
plat language) and copied to the Environmental Resources Department.
2. Prior to the issuance of any building permits or land clearing activities for the
individual lots, the individual lot owners shall be required to submit a
Vegetation Removal Permit from the Sl Lucie County Environmental Resource
Department for review and approval.
3. Prior to the recordation of any final plats for the proposed project, the
developer, his successors or assigns, shall install a catch basin via a right-of-
way permit or license agreement.
4. This Development Order shall be recorded in the Public Records of St. Lucie
County, Florida. This Development Order shall be recorded in order to provide
constructive legal notice of development conditions that run with the land.
5. The Final Plat shall not be recorded until constructible engineering plans are
approved, and all public and common improvements, including those items
referenced in Condition Number 3, are either: a) built and accepted or
approved by St. Lucie County; or b) secured with a developer's surety held by
the St. Lucie County in a form approved by the County Attorney and an amount
approved by the County Engineer, including an amount necessary to cover the
period of maintenance required by the Land Development Code.
6. Pursuant to Section 11.03.02 and 11.04.00 of the St. Lucie County Land
Development Code constructible engineering plans shall be submitted to the
County Engineer.
7.. The County Engineer shall receive a copy of this Development Order and the
site plan it approves and shall not approve constructible engineering plans or
cost estimates that do not implement or are not consistent with this
Development Order and the plans hereby approved.

The approvals granted by this administrative order shall expire on May 16, 2008, unless a
building permit is issued or an extension is granted in accordance with the provisions of
Section 11.02.06 of the St. Lucie County Land Development Code.
The Final Site Plan approval granted under this Resolution is specifically conditioned to the
requirement that the petitioner, Anthony Nardone, including any successors in interest, shall
obtain all necessary development permits and construction authorizations from the
appropriate State and Federal regulatory authorities including, but not limited to; the United
States Army Corps of Engineers, the Florida Department of Environmental Protection, and
the South Florida Water Management District, prior to the issuance of any local building
permits of authorizations to commence development activities on the property described in
PartA.
A copy of this Order shall be attached to the site plan drawings described in Part A, which
plan shall be placed on file with the St. Lucie County Grow1h Management Director and
mailed, return receipt requested to the developer and agent of record as identified on the
site plan applications.
The certificate of capacity, attached as Exhibit A, shall be valid for the same period as this
order. If this order expires or otherwise terminates, the certificate of capacity shall
automatically terminate.
This order shall be recorded in the Public Records of St. Lucie County.
