Christensen Farms Subdivision. is a proposed 5-lot subdivision for property located on the west side of Christensen Road, approximately 0.30 mile south of West Midway Road in the AR-1 (Agricultural, Residential - 1 du/acre) Zoning District. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be oonsistent with the St. Lucie County Comprehensive Plan. 3. The project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development Code. 4. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 6. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The project is to be served by adequate public facilities and services. 8. The applicant has applied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, SI. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 (D) of the St. Lucie County Land Development Code, the proposed Minor Site Plan to be known as Christensen Fanns SID, is hereby approved as shown on the site plan drawings for the project prepared by The Velcon Group, Inc., dated November 1, 2004, and received by the St. Lucie County Growth Management Director on November 5, 2004, for the property described in Part "B" below, subject to the following condition: File No.: MNSP-04-021 May 16, 2005 GM Order 05-011 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 B. 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 C. 41 42 43 44 45 D. 46 47 48 1. Prior to the issuance of the first Building Pennit for the proposed project, the petitioner, his successors or assigns, shall convey to St. Lucie County, in manner and form acceptable to the St. Lucie County Attorney, the east 5 feet of the subject property for additional right-of-way for Christensen Road. To the extent permitted under the County's Code and Compiled Laws, any such dedication may be considered eligible for Road Impact Fee Credits. 2. Prior to the recordation of the final plat of Christensen Farms Subdivision, the developer, his successors or assigns, shall submit fees in the amount of $48,790.63 for the fair share contribution toward paving of Christensen Road. The property on which this minor site plan is being granted is described as follows: ALL OF LOTS 112,113.. AND 119 LYING EAST OF DRAINAGE CANAL NO. 103 LESS THE NORTH 130 FEET OF LOTS 112AND 113, ACCORDING TO THE PLAT OF WHITE CITY SUBDIVISION OF RECORD IN THE OFFICE OF THE CLERK OF CIRCUIT COURT, ST. LUCIE COUNTY, FLORIDA IN PLAT BOOK 1, PAGE 23, ALL IN SECTION 5 TOWNSHIP 36 SOUTH, RANGE 40 EAST, SUBJECT TO AND LESS ANY RIGHTS-F-WA Y FOR PUBLIC ROADS AND DRAINAGE CANALS ALSO LESS AND EXCEPT AS PORTION OF LOT 119 BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE INTERSECTION OF THE NORTHEAST CORNER OF LOT 119 WITH THE WESTERLY RIGHT-OF-WAY LINE OF CHRISTENSEN ROAD; THENCE RUN SOUTH 00°04'17" EAST ALONG SAID RIGHT-OF-WAY A DISTANCE OF 262.81 FEET TO THE POINT OF BEGINNING; THENCE, CONTINUE SOUTH 00°04'17" EAST ALONG SAID RIGHT-OF-WAY A DISTANCE OF 387.03 FEET TO THE SOUTHEAST CORNER OF SAID LOT 119; THENCE, RUN NORTH 89°52'55" WEST ALONG THE SOUTH LINER OF LOT 119 A DISTANCE OF 530.04 FEET TO A POINT; THENCE, RUN NORTH 05°24'15" WEST A DISTANCE OF 398.88 FEET TO A POINT; THENCE, RUN SOUTH 89°452'55" EAST A DISTANCE OF 567.11 FEET TO THE POINT OF BEGINNING. (Tax ID#: 3403-502~204- 00017) (Location: West side of Christensen Road, approximately 0.30 mile south of West Midway Road) The approvals granted by this administrative order shall expire on May 16, 2007, unless final plat approval is granted or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. The Final Site Plan approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, Matthew Nyberg, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to; the United States Army Corps of Engineers, File No.: MNSP-Q4-021 May 16, 2005 GM Order 05-011 Page 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. E. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. F. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. G. This order shall be recorded in the Public Records of St. Lucie County.
