LUCIE COUNTY LAND DEVELOPMENT CODE - NORTH FORK OF THE ST. LUCIE RIVER SHORELINE SET BACK REQUIREMENTS FOR RICHARD AND LORRAINE LEWIS WHEREAS, the SI. Lucie County Growth Management Director has reviewed the application for a Variance from Section 6.02.02(B)(2)(a) and made the following determinations: 1 . Richard and Lorraine Lewis, presented a petition for a variance from the provisions of Section 6.02.02(B)(2)(a), SI. Lucie County Land Development Code for the purpose of building a single family residence in the project known as Hidden River Estates in SI. Lucie County, Florida. The subject property is located on part of Lot 1 , Block 2, Hidden River Drive in Port SI. Lucie, Florida. 2. On May 11, 2006, the Growth Management Director and the Environmental Resources Director reviewed the application requesting a variance from Section 6.02.02(B)(2)(a), SI. Lucie County Land Development Code to permit the development of one single-family residence that lacks a maximum of 10 feet of the minimum 50 foot rear setback from the mean high water line for lots of record platted as of August 1, 1989, which are located along the North Fork of the SI. Lucie River. 3. After consideration of the application presented, including staff comments and the standards of review for granting variances set out in Section 10.01.30, SI. Lucie County Land Development Code, the Growth Management Director and the Environmental Resources Director have made the following determinations: 1. The requested variance meets the standards of review as set forth in Section 10.01.30 of the St. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan. 2. The requested variance is necessary to allow development of the site for a single family residence. 3. Granting of this variance to allow for a 40 foot buffer will not adversely affect the North Fork of the St. Lucie River. The applicant shall replant the remaining forty feet of buffer with appropriate native vegetation including ground cover, under story and canopy. The plantings shall be approved by the Environmental Resources Department and shall be installed prior to release of the Certificate of Occupancy for the property. NOW, THEREFORE, BE IT ORDERED: The petition for a Variance of 10 feet from the provisions of Section 6.02.02(B)(2)(a), S1. Lucie County Land Development Code, North Fork of the S1. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer, or authorized agent wish to appeal any condition described in Section A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.03(B), S1. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. This Order shall be recorded in the Public Records of S1. Lucie County. ORDER effective the 26th day of May 2006.
