Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 16 CHANGE IN ZONING 17 18 1. Centerline Acquisitions LLC presented a petition for a Change in Zoning 19 from the AR-1 (Agricultural, Residential- 1 du/acre) to the PUD (Planned Unit 20 Development - Ravinia) Zoning District for the project to be known as Ravinia 21 PUD, for property located on the south side of West Midway Road, 22 approximately y.. mile west of South 25th Street, for certain property in SI. 23 Lucie County, Florida as depicted on the attached maps as Exhibit "A" and 24 described in Part "A" below. 25 26 2. The Development Review Committee has reviewed the site plan for the 27 proposed project and found it to meet minimum technical requirements. 28 29 3. On September 15, 2005, the SI. Lucie County Planning and Zoning 30 Commission held a public hearing on the petition of Centerline Acquisitions 31 LLC, for a change in zoning from the AR-1 (Agricultural, Residential - 1 32 du/acre) Zoning District to the PUD (Planned Unit Development - Ravinia) 33 Zoning District, after publishing a notice of such hearing in the Fort Pierce 34 Tribune and notifying by mail all property owners within 500 feet of the 35 property boundaries, and recommended that the Board of County 36 Commissioners deny Preliminary Planned Unit Development approval for the 37 project to be known as Ravinia- PUD, for the property depicted on the 38 Attached Maps as Exhibit "A" and described in Part "A" below. 39 40 4. On November 8, 2005, this Board approved the petition of Centerline 41 Acquisitions LLC for Preliminary Planned Unit Development Site Plan for the 42 project known as Ravinia - PUD after holding held a public hearing and 43 publishing a notice of such hearing in the Tribune and notifying by mail all 44 property owners within 500 feet of the subject property. 45 June 20, 2006 Page 1 EDWIN M. On June 6, 2006, the SI. Lucie County Board of County Commissioners held 2 a public hearing on the petition of Centerline Acquisitions LLC for a change 3 in zoning from the AR-1 (Agricultural, Residential- 1 du/acre) Zoning District 4 to the PUD (Planned Unit Development - Ravinia) Zoning District after 5 publishing a public notice of such hearing in the Tribune and notifying by mail 6 all owners of property within 500 feet of the subject property at least 10 days 7 prior to the hearing. That meeting was continued to the Board's meeting of 8 June 20, 2006. 9 10 6. On June 20, 2006, this Board held the public hearing on the petition of 11 Centerline Acquisitions LLC for a change in zoning from the AR-1 12 (Agricultural, Residential - 1 du/acre) Zoning District to the PUD (Planned 13 Unit Development - Ravinia) Zoning District after notifying by mail all owners 14 of property within 500 feet of the subject property and granted final approval 15 to the property described in Part "A" below. 16 17 7. The proposed change in zoning is consistent with the goals, objectives, and 18 policies of the SI. Lucie County Comprehensive Plan and has satisfied the 19 requirements of Section 11.06.03 of the SI. Lucie County Land Development 20 Code. 21 22 23 SITE PLAN 24 25 1. Centerline Acquisitions LLC presented a petition for Final Planned Unit 26 Development Approval for a 120-unit single family residential subdivision to be 27 known as Ravinia - PUD. 28 29 2. The Development Review Committee has reviewed the site plan for the 30 proposed project and found it to meet minimum technical requirements. 31 32 3. On September 15, 2005, the SI. Lucie County Planning and Zoning 33 Commission held a public hearing on the petition of Centerline Acquisitions 34 LLC, after publishing a notice of such hearing in the Fort Pierce Tribune and 35 notifying by mail all property owners within 500 feet of the property boundaries 36 and recommended denial of this petition. 37 38 4. On November 8, 2005, this Board approved the petition of Centerline 39 Acquisitions LLC for Preliminary Planned Unit Development Site Plan for the 40 project known as Ravinia - PUD after holding held a public hearing and 41 publishing a notice of such hearing in the Tribune and notifying by mail all 42 property owners within 500 feet of the subject property. 43 44 5. On June 6, 2006, this Board held a public hearing on the petition of Centerline 45 Acquisitions LLC, for Final Planned Unit Development approval for the project June 20, 2006 Page 2 Resolution No. 06-159 File No.: RZ-04-o51and PUD-06-012 I known as Ravinia - PUD after publishing a notice of such hearing in the 2 Tribune and notifying by mail all property owners within 500 feet of the subject 3 property. That meeting was continued to the Board's meeting of June 20, 4 2006. 5 6 6. On June 20, 2006, the public hearing on this matter was heard. 7 8 7. The proposed project is consistent with the general purpose, goals, objectives 9 and standards of the SI. Lucie County Land Development Code, the SI. Lucie 10 County Comprehensive Plan, and the Code of Ordinances of SI. Lucie 11 County. 12 13 8. The proposed project will not have an undue adverse effect on adjacent 14 property, the character of the neighborhood, traffic conditions, parking, utility 15 facilities or other matters affecting the public health, safety and general 16 welfare. 17 18 9. All reasonable steps have been taken to minimize any adverse effect of the 19 proposed project on the immediate vicinity through building design, site 20 design, landscaping and screening. 21 22 10. The proposed project will be constructed, arranged and operated so as not to 23 interfere with the development and use of neighboring property, in accordance 24 with applicable district regulations. 25 26 11. The proposed project will be served by adequate public facilities and services. 27 28 12.A Certificate of Capacity was granted for this project on November 2,2005. 29 30 31 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of 32 SI. Lucie County, Florida: 33 34 35 36 A. 37 38 39 40 41 42 43 44 45 CHANGE IN ZONING The proposed Change in Zoning from the AR-1 (Agricultural, Residential - 1 du/acre) Zoning District to the PUD (Planned Unit Development - Ravinia) Zoning District, owned by Centerline Homes at Ravinia LLC., is hereby granted for the following described property: THE EAST 312.5 FEET OF LOT 98 OF SECTION 5, TOWNSHIP 36 SOUTH, RANGE 40 EAST, WHITE CITY SUBDIVISION, ACCORDING TO THE MAP OR PLAT THEREOF AS RECORDED IN PLAT BOOK 1, PAGE(S) 23, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA EXCEPTING HOWEVER THE ABOVE DESCRIBED LAND ALL RIGHTS- OF-WAY FOR PUBLIC ROADS AND DRAINAGE CANALS. Location: South side of West Midway Road, approximately 1/2 mile west of South 25th Street. ParcellD No.: 3403-502-0166-0008 and 3403-502-0200-0009 SITE PLAN B. Pursuant to Section 11.02.05(B) of the SI. Lucie County Land Development Code, the Final Planned Unit Development Site Plan for the project to be known as Ravinia _ A Planned Unit Development be, and the same is hereby, approved as shown on the site plan drawings for the project prepared by Julian Byran & Associates, PA dated September 1, 2004, subsequently revised through April 10, 2006, and date stamped received by the SI. Lucie County Growth Management Director on May 24, 2006, subject to the following conditions: 1. The Final Plat for the Ravinia PUD shall not be recorded until constructible engineering plans are approved, and all common improvements are either: a) built and accepted or approved by SI. Lucie County; or b) appropriate security is provided to SI. Lucie County in a form approved by the County Attorney and an amount approved by the County Engineer, including an amount necessary to cover the period of maintenance required by the Land Development Code. 2. No final site construction or Development Permits shall be issued by the County until a complete set of sealed constructible final engineering plans, supporting calculations and survey data for all site work and offsite improvements are submitted to the County and approved by the Public Works Department, Utilities Department, Environmental Resources Department, Growth Management Department, Fire District, and any other agency or County Department that may be determined by the Director of Growth Management to be necessarily involved in the review and approval of the constructible final engineering plans for the site work and offsite improvements. The determination of whether or not plans submitted by the applicant constitute a complete set of constructible plans shall be made by June 20, 2006 Page 4 Resolution No. 06-159 File No.: RZ-04-o51 and PUD-06-012 I the departments involved in the plan review within five (5) business days of 2 the date the plans are received in the Department of Growth Management. 3 4 3. Prior to the recording of any Final Plat approval for the project, the applicant 5 (aka Developer), successors, or assigns shall provide certain improvements 6 to roadways, including bike paths and sidewalks, required to address this 7 projects impacts on the County's roadway network. The following include, but 8 are not limited to the improvements required to be provided: 9 10 a) Should the Developer choose to bond all the improvements, a signed II and sealed certified engineer's estimate of probable cost shall be 12 submitted along with a fully executed Subdivision Improvement 13 Agreement. The bond and or Letter of Credit shall include a 15% 14 contingency for all public improvements. These improvements would 15 include but are not limited to the required turn lanes on West Midway 16 Road and the paving and drainage of Christensen Road. 17 18 b) After acceptance by the County of the constructed improvements the 19 developer will be required to enter into a Maintenance Agreement and 20 provide security in the amount of 15% of the cost of construction. The 21 period of maintenance shall be for (1) one year and (30) thirty days. 22 23 c) Prior to any authorization for building permits for the construction of 24 single family homes in this project; the applicant shall provide engineering 25 plans for the Christensen Road improvements and the required turn lanes 26 on West Midway Road. The engineering plans shall be submitted to the 27 County Engineer for review and approval prior to the release of this 28 condition. 29 30 d) Prior to the issuance of the first Certificates of Occupancy, Christensen 31 Road shall be paved from the project access point to West Midway Road. 32 All construction within the Public Road right-of-way shall be approved by 33 the County Engineer or his designee. 34 35 e) Prior to the issuance of any Certificate of Occupancy, the developer, or 36 his assigns, shall be required to provide for the cost of constructing a left 37 and right turn lanes at the projects West Midway Road entrance, as 38 approved by the County Engineer. 39 40 4. Prior to, or as part of, the final platting of the subject property, the developers 41 shall be required to convey to SI. Lucie County, in manner and form 42 acceptable to the SI. Lucie County Attorney, 40 feet of additional right-of-way 43 along the site plan's northern property line for the future widening of West 44 Midway Road and 5 feet along it's western property line for the future 45 widening of Christensen Road. To the extent permitted under the County's June 20, 2006 Page 5 Resolution No. 06-159 File No.: RZ-04-o51and PUD-06-012 1 Code and Compiled Laws, any such dedication may be considered eligible for 2 Road Impact Fee Credits. 3 4 5. The use of Christensen Road as a construction entrance for the project shall 5 be prohibited. All construction vehicles are to utilize the main entrance point 6 on West Midway Road. 7 8 6. Prior to Final Plat approval for this project, the developers, their successors 9 and assigns, shall have entered into an enforceable utility service agreement 10 with City of Port SI. Lucie Utilities District to ensure the provision of water and 11 sewer services. This agreement shall be in a form consistent with the City of 12 Port SI. Lucie Utility Department's regulations regarding utility service 13 extensions and service provisions. 14 15 7. An executed (signed) copy of the required conservation easement document 16 must be provided to SLC Environmental Resources Division prior to the 17 issuance of a SLC Vegetation Removal Permit. Also, within 60 days of 18 issuance of a permit a recorded copy of the easement document will be 19 required to be submitted. 20 21 8. Prior to the issuance of a Certificate of Occupancy for the first residence or 22 structure to be completed, proof of purchase of the 1.5 to 3 wetland mitigation 23 credits shall be provided to 81. Lucie County. 24 25 9. Prior to the issuance of a SI. Lucie County Vegetation Removal Permit, a 26 location map of all active, inactive, and abandoned gopher tortoise burrows 27 on-site be submitted and approved by the Environmental Resources 28 Department. 29 30 31 GENERAL PROVISIONS 32 33 C. This Final Planned Unit Development Site Plan approval shall expire on June 20, 34 2008, unless a building permit is issued or an extension is granted in accordance 35 with Section 11.02.06(B)(3), SI. Lucie County Land Development Code. 36 37 D. The Final Planned Unit Development Site Plan/General Site Plan approval granted 38 under this Resolution is specifically conditioned to the requirement that the 39 petitioner, Centerline Acquisitions LLC, including any successors in interest, shall 40 obtain all necessary development permits and construction authorizations from the 41 appropriate State and Federal regulatory authorities, including but not limited to; the 42 United Stated Army Corp of Engineers, the Florida Department of Environmental 43 Protection, and the South Florida Water Management District, prior to the issuance 44 of any local building permits of authorizations to commence development activities 45 on the property described in Part A. 46 June 20, 2006 Page 6 Resolution No. 06-159 File No.: RZ-04-051and PUD-06-o12 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 E. A Certificate of Capacity was granted by the Growth Management Director on November 2, 2005, which certificate shall remain valid for the period of Site Plan approval or any extension granted thereto. F. A copy of this resolution shall be attached to the site plan drawings described in Part B, which plan shall be placed on file with the SI. Lucie County Growth Management Department. G. The SI. Lucie County Growth Management Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of SI. Lucie County, Florida, and to make notation of reference to the date of adoption of this resolution. H. The Director of Growth Management shall coordinate the issuance of further site Development Permits. No final site construction authorizations or site Development Permits shall be issued until all requirements for such permits are met. I. A copy of this resolution shall be mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. J. This resolution shall be recorded in the Public Records of SI. Lucie County. The recording of this resolution does not authorize the commencement of anyon-site development activities without obtaining such further development permits as may be required. All applicable conditions of approval as set forth above, and all applicable code requirements must be met to the satisfaction of the County before final site construction permits are issued. K. The conditions set forth in Part B are an integral nonseverable part of the site plan approval granted by this Resolution. If any condition set forth in Section B is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this resolution shall become null and void. L.
