A RESOLUTION DENYING A CHANGE IN ZONING FROM THE
AR-1 (AGRICULTURAL, RESIDENTIAL -1 DUlACRE) ZONING
DISTRICT TO THE RS-2 (RESIDENTIAL, SINGLE-FAMILY - 2
DUlACRE) ZONING DISTRICT OF CERTAIN PROPERTY IN ST.
LUCIE COUNTY, FLORIDA.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on
the testimony and evidence, including, but not limited, to the staff report, has made the
following determinations:
1. S & H Business, Inc., presented a petition for a change in zoning from the AR-1
(Agricultural, Residential - 1du/acre) Zoning District to the RS-2 (Residential,
Single-Family - 2 du/acre) Zoning District for the property depicted on the
attached maps as "Exhibit A" and described in Part A below.
2. On July 20, 2006, the St. Lucie County Planning and Zoning Commission held a
public hearing on the petition, after publishing a notice of such hearing in a local
daily newspaper of general circulation and notifying by mail all property owners
within 500 feet of the subject property, and recommended that the Board of
County Commissioners deny a change in zoning from the AR-1 (Agricultural,
Residential- 1 du/acre) Zoning District to the RS-2 (Residential, Single-Family - 2
du/acre) Zoning District.
3. On August 15, 2006, the St. Lucie County Board of County Commissioners held a
public hearing on the petition, after publishing a notice of such hearing in a local
daily newspaper of general circulation and notifying by mail all property owners
within 500 feet of the subject property, and denied the requested change in zoning
for the property described in Part A below.
4. The proposed project is inconsistent with the general purpose, goals, objectives
and standards of the St. Lucie County Land Development Code, the St. Lucie
County Comprehensive Plan, and the Code of Ordinances of St. Lucie County and
is incompatible with the adjacent development pattern of the surrounding
neighborhood.
5. The proposed change in zoning has not satisfied the requirements of Section
11.06.03 of the St. Lucie County Land Development Code, is inconsistent with the

goals, objectives, and policies of the St. Lucie County Comprehensive Plan, and
is conflict with the public interest.
The proposed change in zoning is inconsistent with the existing and proposed use
of property in the surrounding area, which have horses and is rural in character.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St.
Lucie County, Florida:
A. The proposed Change in Zoning District from the AR-1 (Agricultural, Residential-
1du/acre) Zoning District to the RS-2 (Residential, Single-Family - 2 du/acre)
Zoning District for the property depicted on the attached maps as "Exhibit A" and
described as follows:
TRACT 10, BLOCK 1, PLAT NO.1, SAINT LUCIE GARDENS. LOCATED IN SECTION 23,
TOWNSHIP 36 SOUTH, RANGE 40 EAST, ACCORDING TO THE PLAT THEREOF AS
RECORDED IN PLAT BOOK 1, PAGE 35 OF THE PUBLIC RECORDS OF SAINT LUCIE
COUNTY, FLORIDA.
CONTAINING 383,727 SQUARE FEET OR 8.8092 ACRES MORE OR
LESS.
(Location:
Northeast of the intersection of Tilton Road and Silver Oak Drive.)
Owned by S & H Business, Inc. is hereby denied.
B. An application for the same amendment to the Official Zoning Atlas shall not be
considered by this Board for a period of two (2) years from the date of this action.
