Ii '\b f¡j¡\,\ p,,~ tl'-'l ¡It., RESOLUTION NO. 06-230 FILE NO.: CU-06-010 A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO ALLOW A MOTOR VEHICLE BODY REPAIR SERVICE IN THE CG (COMMERCIAL, GENERAL) ZONING DISTRICT FOR PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of SI. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. MLF Prooerties, LLC, presented a petition for a Conditional Use Permit for the operation of a motor vehicle body repair service in the CG (Commerciai, General) Zoning District for the property described in Part A. 2. On August 17, 2006, the SI. Lucie County Planning and Zoning Commission held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners approve the hereinafter described request for a Conditional Use Permit in CG (Commercial, General) Zoning for the property described below. 3. On September 19, 2006, this Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by maii all owners of property within 500 feet of the property. 4. The proposed Conditional Use is consistent with the goals, objectives, and policies of the SI. Lucie County Comprehensive Plan and has satisfied the requirements of Section 11.07.03 of the SI. Lucie County Land Development Code. 5. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utiiity facilities, or other matters affecting the public health, safety and general welfare. 6. The applicant has appiied for and received a certificate of exemption, a copy of which is attached to this order as Exhibit "A", as required under Chapter V, SI. Lucie County Land Development Code. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of SI. Lucie County, Florida: A. Pursuant to Section 11.07.03 of the SI. Lucie County Land Development Code, a Conditionai Use Permit for MLF Properties, LLC to allow a motor vehicle body repair service in the CG (Commercial, General) Zoning District is hereby granted for the property described below, subject to the following conditions: 1. The developer, his successor or assigns, shall provide a landscape plan prepared by a Florida registered landscape architect, providing for a wall between non-residential and residential uses, 8 feet in height, constructed of concrete block with 60% of the required landscaping on the outside and 40% on the inside of the wall. B. The approvals and authorizations granted by this Resolution are for the purpose of obtaining permits on this property and shall expire on September 19, 2007, unless the deveioper has obtained a building permit approvai for the uses described in Part A above, or an extension has been granted in accordance with Section 11.07.05(F), SI. Lucie County Land Development Code. C. The SI. Lucie County Growth Management Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of SI. Lucie County, Florida, and to make notation of reference to the date of adoption of this resolution.
