GM-06-019 MNSP-Ø5-Ø35 AN ORDER GRANTING APPROVAL FOR A MINOR SITE PLAN TO BE KNOWN AS PARADISO AT NORTH HUTCHINSON ISLAND. WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for site plan approval submitted by Thomas Lucido & Associates, P.A., reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1. Paradiso at North Hutchinson Island is a proposed 44-unit multiple family project consisting of one - 2 unit building and 14 - 3 unit buildings for property located on the west side of North SR A-1-A, approximately 500 feet south of Bonita Isle Drive in the HIRD (Hutchinson Island Residential District) Zoning District. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 3. The project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development Code. 4. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 6. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The project is to be served by adequate public facilities and services. 8. The applicant has applied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed Minor Site Plan to be known as Paradiso at North Hutchinson Island, is hereby approved as shown on the site plan drawings for the project prepared by Thomas Lucido & Associates, P.A., dated December 12, 2005, and received by the St. Lucie County Growth Management Director on August 21, 2006, for the property described below, subject to the following conditions: 1. Prior to the issuance of a St Lucie County Vegetation Removal Pennit an approved Florida Fish and Wildlife Conservation Commission, gopher tortoise relocation pennit, shall be submitted to the St Lucie County Environmental Resource Department No incidental take pennits for the on-site gopher tortoises shall be allowed. 2 Prior to the approval of a St Lucie County Building Pennit to construct the observation deckl gazebo, proposed to extend out over the water in the Ft Pierce Cut, a seagrass and benthic habitat survey shall be conducted and all efforts shall be made by the applicant to avoid or minimize impacts to any seagrass beds and benthic habitats. 3. Prior to the issuance of a St Lucie County Vegetation Removal Pennit, a completed and executed conservation easement, shall be submitted to the Environmental Resource Department 4. Prior to the issuance of a building pennit for the first residential unit, the developer, his successor or assigns, shall provide right and left turn lanes at the project entrance on North SR A-i-A. The turn lanes shall be constructed in accordance with the Florida Department of Transportation Manual of Unifonn Minimum Standards for Desian. Construction. and Maintenance for Streets and Hiahwavs. unless FOOT requires the use of a different deceleration and turn lane standard in pennitting the driveway. Confinnation in writing from FDOT will be needed in the event that FOOT will not pennit and approve either or both of the turn lanes, then the construction of such turn lane(s) will not be required for the project Except that if FDOT denies a pennit for turn lanes because of improper design, the FDOT pennit application shall be revised to meet FDOT requirements, resubmitted, and tum lanes shall be constructed following FDOT approval. 5. No clearing or other site work shall commence until after constructible engineering plans have been approved by the County Engineer and all county environmental pennits have been issued by Environmental Resources Department pursuant to Section ii.02.08(AK7) of the St Lucie County Land Development Code. No work shall commence after the issuance of environmental pennits by county, or of any other pennits by any other agency, until the County Engineer has approved the constructible site plans. 6. Pursuant to Section 11.02.08(A)(6) of the Sl Lucie County Land Development Code, no work shall commence on the site until all regulatory pennits required from Federal, State, and regional agencies and special districts have been issued. The Florida Department of Environmental Protection, National Pollutant Discharge and Elimination System compliance notice must be submitted to the County Engineer with the constructible site plan at the time of building pennit application or during pennit review or no paving, grading, and drainage pennit and no building pennit shall be issued. All National Pollutant Discharge and Elimination System Best Management Practices shall be instituted on the site prior to site clearing and maintained daily. Stonnwater ponds shall be roughed in at the same time the site is cleared of groundcover. 7. This Development Order shall be recorded in the Public Records of Sl Lucie County, Florida, in order to provide constructive legal notice of development conditions that run with the land. 8. The Code Compliance Manager shall receive a copy of this Development Order and the site plan it approves and shall not approve any building pennits that do not implement or are not consistent with this Development Order and the plans hereby approved. B. The property on which this Minor Site Plan is being granted is described as follows: PARCEL 1: THAT PARK OF THE SOUTH 100.00 FEET OF THE NORTH 700.00 FEET, OF THE SE V. OF SECTION 23, TOWNSHIP 34 SOUTH, RANGE 40 EAST LYING WEST OF STATE ROAD A-i-A, ST. LUCIE COUNTY, FLORIDA CONTAINING 3.445 ACRES, MORE OR LESS. PARCEL II: THAT PART OF THE SOUTH 100.00 FEET OF THE NORTH 800.00 FEET LYING WEST OF STATE ROAD A-1-A IN THE FRACTIONAL SOUTHEAST QUARTER (SE1/4) OF SECTION 23, TOWNSHIP 34 SOUTH, RANGE 40 EAST, ST. LUCIE COUNTY, FLORIDA. CONTAINING 3.52 ACRES, MORE OR LESS. TOTAL AREA CONTAINING 6.97 ACRES, MORE OR LESS. The approvals granted by this administrative order shall expire on August 23, 2008, unless building permits are issued or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The Final Site Plan approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, GKK-Hlsland, Ltd., including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. E. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Director and mailed, retum receipt requested to the developer and agent of record as identified on the site plan applications. F. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. G. This order shall be recorded in the Public Records of St. Lucie County.
