WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for site plan approval submilled by Culpepper & Terpening, Inc., reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1. Round Island Plantation is a proposed 38 unit residential community. The subject property is generally located on both sides of North SR A-1-A, immediately south of the Indian River County line. Twenty-five single family residences are proposed for the west side and 13 residences consisting of 6-2unit buildings and 1-1 unit building are proposed for the east side. All of the subject property is zoned HIRD (Hutchinson Island Residential District) Zoning District. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 3. The project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development Code. 4. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 6. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The project is to be served by adequate public facilities and services. 8. The applicant has applied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed Minor Site Plan to be known as Round Island Plantation, is hereby approved as shown on the site plan drawings for the project prepared by Culpepper & Terpening, Inc., dated March 25, 2005, and received by the St. Lucie County Growth Management Director on August 14, 2006, for the property described below, subject to the following conditions: EDWIN M. Prior to the issuance of any building pennits or vegetation removal pennits for any portion 3 of the Round Island Plantation site, the developers, their successor or assigns, shall 4 submit to St. Lucie County Environmental Resources Department a completed Sea Turtle 5 Protection Plan consistent with the provisions of Section 6.04.02 of the St. Lucie County 6 Land Development Code. 7 8 2. Prior to the issuance of any building pennits or vegetation removal pennits for any portion 9 of the Round Island Plantation site, the developers, their successor or assigns, shall 10 conduct an updated gopher tortoise survey of the property to verify the location of all 11 active and inactive burrows on the property. In the event that any active gopher tortoise 12 burrows are detennined to be in an area of planned land development activity, the gopher 13 tortoise(s), their burrows, and an adequate amount of habitat shall either be protected in 14 place or relocated to a suitable on-site area that will not be distributed as a result of the 15 land development activity. All such protection shall be done in accord with the applicable 16 Florida Fish and Wildlife Conservation Commission regulations goveming Gopher 17 Tortoise protection, except that in no instance shall St. Lucie County agree to the 18 issuance of any incidental taking pennits allowing for the elimination of any active gopher 19 tortoise burrows or tortoises on this property. 20 21 3. Prior to the issuance of any building pennits or vegetation removal pennits for any portion 22 of the Round Island Plantation site, the developers, their successor or assigns, shall 23 conduct a pnH:learing meeting with the applicant's environmental consultant, the land 24 clearing contractors, and St. Lucie County Environmental Resources Department staff to 25 discuss listed species and habitat protection guidelines during construction. 26 27 4. Prior to the issuance ofany building pennits or vegetation removal pennits for any portion 28 of the Round Island Plantation site, the developers, their successor or assigns, shall 29 submit to St. Lucie County a shoreline stabilization plan and assessment which 30 demonstrates consistency with the appropriate policies set out in the St. Lucie County 31 Land Development Code, including beach or dune restoration and maintenance to reduce 32 or control erosion and detailed beach/dune restoration plans including existing and 33 proposed elevations, types and quantities of plants, proposed methods to assure plant 34 survival (i.e.; temporary irrigation), timing, etc. 35 3 6 5. Prior to the issuance of any local construction pennits for any dune cross-over structures, 37 the developers, their successor or assigns, shall submit to St. Lucie County a Florida 38 Department of Environmental Protection approved dune crossover plan and verification 39 that the construction of this cross-over structure is consistent with the project's dune 40 preservation and management plan. 41 4 2 6. Prior to the issuance of any building pennits or vegetation removal pennits for any portion 43 of the Round Island Plantation site, the developers, their successor or assigns, shall 4 4 submit to St. Lucie County verification of wetland boundaries shown on the site plan by 45 the U.S. Anny Corps of Engineers. In the event that any agency, including the U.S. Anny 46 Corps of Engineers, detennines that a different wetland boundary line is to be followed, 47 then the project site plan shall be amended to reflect the new boundary definitions and all 48 necessary adjustments shall be made to the project site plan as may be required. 49 File No.: MNSP-05-û35 August 23, 2006 GM Order 06-û21 Page: 2 1 7. Prior to the issuance of any building pennits or vegetation removal pennits for any portion 2 of the Round Island Plantation site, the developers, their successor or assigns, shall 3 submit to St. Lucie County copies of all South Florida Water Management Department, 4 Florida Department of Environmental Protection, and U.S. Anny Corps pennits as they 5 relate to this proposed project identifying all areas of allowed impacts and any required 6 mitigation. 7 8 8. Prior to the issuance ofany building permits or vegetation removal pennits forany portion 9 of the Round Island Plantation site, the developers, their successor or assigns, shall 10 submit to St. Lucie County a copy of the Homeowners Association guidelines 11 (Homeowners/Property Owners Association or Declaration of Covenant documents) 12 pertaining to the preserve areas and protected vegetation areas, specifically identifying all 13 responsible parties associated with the long tenn maintenance of the common element 14 areas in this community. The guidelines shall specify restrictions on any encroachment 15 into the Preserve Areas, as well as restrictions on vegetation removal outside the building 16 pad areas. At a minimum the documents shall include: 17 18 a. Language which notifies prospective property owners that the association 19 property includes wetland and upland preservation areas which are protected 20 under conservation easements; and 21 22 b. Language which infonns the prospective property owners that the wetlands and 23 upland preserve areas may not be altered from their natural! pennitted condition 24 with the exception of: exotic vegetation removal, or restoration in accordance with 25 a referenced restoration plan. 26 27 9. Prior to the issuance of any building pennits or vegetation removal pennits for any portion 28 of the Round Island Plantation site, the developers, their successor or assigns, shall 29 submit to St. Lucie County a revised Preserve Area Monitoring and Management Plan, 30 identifying and addressing all of the preserve areas on this Round Island site. 31 32 10. Prior to the issuance ofany building pennits or vegetation removal pennits for any portion 33 of the Round Island Plantation site, the developers, their successor or assigns, shall 34 clearly delineate all areas to be preserved and/or protected per the approved site plan. 35 Delineation shall be by either the placing of silt fencing, safety fencing or similar type of 36 materials. Flagging shall not be used except to guide the installation of the fencing 37 materials. All land clearing activities shall be in accordance to the specific 38 conditions/standards outlined in the Vegetation Removal Pennit. Prior to issuance of any 39 building pennits or vegetation removal pennits, the St. Lucie County Environmental 40 Resources Department shall inspect the installed fencing. 41 42 11. As part of the application for vegetation removal at the Round Island Plantation site, a 43 detailed Tree Protection Plan showing where tree barricades will be placed, what the 44 grade changes will be around the trees to be preserved, which methods are proposed to 45 be employed to ensure the trees will not die as a result of increased grade changes (i.e.; 46 drain tiles, etc), who will be responsible for implementing the plan, shall be required to be 47 submitted to St. Lucie County. Prior to the issuance of any building pennits or vegetation removal pennits for any portion 3 of the Round Island Plantation site, the developers, their successor or assigns, shall 4 submit to St. Lucie County an executed and recorded copy of the conservation easement 5 dedicated to St. Lucie County covering the 35.51 acres of preserve areas on this site. At a 6 minimum, the documents shall include: 7 8 a. signed draft conservation easement, 9 lob. site plans or map of conservation easement areas, and 11 12 c. legal description and number of acres of conservation easement. 13 14 13. No clearing or other site work shall commence until after constructible engineering plans 15 have been approved by the County Engineer and all county environmental pennits have 16 been issued by Environmental Resources Department pursuant to Section 11.02.08(A)(7) 17 of the St. Lucie County Land Development Code. As of this date of issuance of this 18 Development Order, no constructible site development plans have been submitted for 19 review. No work shall commence after the issuance of environmental pennits by county, 20 or ofany other pennits by any other agency, untilthe County Engineer has approved the 21 constructible site plans. 22 23 14. Pursuant to Section 11.02.08(A)(6) of the St. Lucie County Land Development Code, no 24 work shall commence on the site until all regulatory pennits required from Federal, State, 25 and regional agencies and special districts have been issued. The Florida Department of 26 Environmental Protection, National Pollutant Discharge and Elimination System 27 compliance notice must be submitted to the County Engineer with the constructible site 28 plan at the time of building pennit application or during pennit review or no paving, 29 grading, and drainage pennit and no building pennit shall be issued. All National Pollutant 30 Discharge and Elimination System Best Management Practices shall be instituted on the 31 site prior to site clearing and maintained daily. Stonnwater ponds shall be roughed in at 32 the same time the site is cleared of groundcover. 33 34 15. This Development Order shall be recorded in the Public Records of St. Lucie County, 35 Florida, in order to provide constructive legal notice of development conditions that run 36 with the land. 37 38 16. The Code Compliance Manager shall receive a copy of this Development Order and the 39 site plan it approves and shall not approve any building pennits that do not implement or 40 are not consistent with this Development Order and the plans hereby approved. 41 42 S. Only driveway permits allowing access through the development shall be allowed for the lots proposed to be developed in Indian River County. The approvals granted by this administrative order shall expire on August 23, 2008, unless building permits are issued or an extension is granted in accordance with the provisions of Section 11.02.06 of the SI. Lucie County Land Development Code. The Final Site Plan approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, Round Island Plantation, LLC, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to: the United Stales Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the SI. Lucie County Growth Management Director and mailed, retum receipt requested to the developer and agent of record as identified on the site plan applications. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate.
