McIntyre, County Attorney St. Lucie County 2300 Virginia Avenue Fort Pierce, FL 34982 RESOLUTION NO. 06-269 DATE: September 19,2006 A RESOLUTION DENYING THE CLOSING, VACATING AND ABANDONMENT OF ST. LUCIE COUNTY AND THE GENERAL PUBLIC IN A PORTION OF AN UNOPENED, UN-MAINTAINED 37.S-FOOT RIGHT-OF-WAY KNOWN AS ALVARADO AVENUE AS SHOWN ON PLAT BOOK S, PAGE 42 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. That Sections 177.101,336.09 and 336.10, Florida Statutes, as amended, and Section 11.10.01 et. seq. of the St. Lucie County Land Development Code, provide that the County may adopt resolutions vacating rights-of-way in whole or in part, which are under the jurisdiction of the Board of County Commissioners of St. Lucie County, Florida. 2. Pursuant to Plat Book 5, Page 42, St. Lucie County and the general public have a dedicated interest in the following described land: Begin at the NW comer of Lot 8, Block 23, of Indrio Unit One Subdivision as per plat thereof as recorded in Plat Book 5, Page 42, of the Public Records of St. Lucie County, Florida, and rrom said point of beginning, thence North 89°39'33" West a distance of 40.72 feet more or less to the West right-of-way line of Alvarado Avenue (consisting of a 37.5 feet wide right-of-way) and from said point, thence South 22°36'39"East a distance 217.22 feet along the western right-of- way 0 f s aid A lvarado A venue a nd from said point, thence South 89°39'33" East a distance 0 f 40.72 feet more or less to the Southwest comer of Lot 7, Block 23, of Indrio Unit One Subdivision as recorded in Plat Book 5, Page 42, of the Public Records of St. Lucie County, Florida, and from said point, thence North 22°36'39" West a distance of 217.22 feet more or less along the East right-of-way line of Alvarado A venue as set forth in the above-described plat to the point of beginning. 1 . . 3. A Notice of Intent to Abandon was advertised on September 10, 2005 and September 17, 2005 and no objections were filed. 4. All relevant public utilities have given written consent for the abandonment. Fort Pierce Utilities Authority received an easement from the petitioner for their utilities. 5. County Department Staff members have reviewed the petition and recommend denial for the following reasons: connectivity to Indrio Road; anticipated growth in the North County and future use for utilities, drainage and roadway connections. 6. All abutting property owners have filed consent fonns and approve the abandonment. 7. On August 1, 2006, the Board of County Commissioners approved Pennission to Advertise for a Public Hearing on September 19, 2006. 8. On September 1,2006, a Notice of Public Hearing was advertised in the Fort Pierce Tribune. 9. It is in the best interest of the public to deny the abandonment of the right-of-way more particularly described as follows: Begin at the NW comer of Lot 8, Block 23, of Indrio Unit One Subdivision as per plat thereof as recorded in Plat Book 5, Page 42, of the Public Records of St. Lucie County, Florida, and from said point of beginning, thence North 89°39'33" West a distance of 40.72 feet more or less to the West right-of-way line of Alvarado Avenue (consisting of a 37.5 feet wide right-of-way) and from said point, thence South 22°36'39"East a distance 217.22 feet along the western right-of- way of said Alvarado A venue and from said point, thence South 89°39'33" East a distance of 40.72 feet more or less to the Southwest comer of Lot 7, Block 23, of Indrio Unit One Subdivision as recorded in Plat Book 5, Page 42, of the Public Records of St. Lucie County, Florida, and from said point, thence North 22°36'39" West a distance of 217.22 feet more or less along the East right-of-way line of Alvarado A venue as set forth in the above-described plat to the point of beginning.
