4 A RESOLUTION GRANTING A CHANGE IN ZONING FROM
5 THE CO (COMMERCIAL, OFFICE) AND CN (COMMERCIAL,
6 NEIGHBORHOOD) ZONING DISTRICTS TO THE AR-1
7 (AGRICULTURAL, RESIDENTIAL - 1 DU/ACRE) ZONING
8 DISTRICT OF CERTAIN PROPERTY IN ST. LUCIE COUNTY,
9 FLORIDA.

11 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based
12 on the testimony and evidence, including but not limited to the staff report, has made
13 the following determinations:

15 1. Daniel and Lisa Nelson presented a petition for a change in zoning from the
16 CO (Commercial, Office) and CN (Commercial, Neighborhood) Zoning Districts
17 to the AR-1 (Agricultural, Residential - 1 du/acre) Zoning District for the
18 property depicted on the attached maps as "Exhibit A" and described below.

20 2. On September 21 2006, the St. Lucie County Planning and Zoning
21 Commission held a public hearing on the petition, after publishing a notice of
22 such hearing in a local daily newspaper of general circulation and notifying by
23 mail all property owners within 500 feet of the subject property, and has
24 recommended that the Board of County Commissioners approve a change in
25 zoning from the CO (Commercial, Office) and CN (Commercial, Neighborhood)
26 Zoning Districts to the AR-1 (Agricultural, Residential - 1du/acre) Zoning
27 District.

29 3. On October 17, 2006, the St. Lucie County Board of County Commissioners
30 held a public hearing on the petition, after publishing a notice of such hearing in
31 a local daily newspaper of general circulation and notifying by mail all property
32 owners within 500 feet of the subject property, and approved the requested
33 change in zoning for the property described in Part A below;

35 4. The proposed project is consistent with the general purpose, goals, objectives
36 and standards of the St. Lucie County Land Development Code, the St. Lucie
37 County Comprehensive Plan, and the Code of Ordinances of St. Lucie County.

39 5. The proposed change in zoning has satisfied the requirements of Section
40 11.06.03 of the St. Lucie County Land Development Code and is
41 consistent with the goals, objectives, and policies of the St. Lucie
42 County Comprehensive Plan.

44 6. The proposed change in zoning is consistent with the existing and the
45 proposed use of property in the surrounding area.

47 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of

cause the change to be made on the Official Zoning Map of St. Lucie County,
Florida, and to make notation of reference to the date of adoption of this
resolution.
