HomeMy WebLinkAbout06-237 · 1 RESOLUTION NO. 06-237 2 File Number: MJSP 05-023 3 4 A RESOLUTION GRANTING APPROVAL TO A MAJOR SITE PLAN 5 PROJECT TO BE KNOWN AS TREASURE COAST MAYFLOWER 6 MOVING AND STORAGE. 7 8 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the 9 testimony and evidence, including but not limited to the staff report, has made the following 10 determinations: 11 12 1. Mark Stromak presented a petition for Major Site Plan approval for the project to be 13 known as Treasure Coast Mayflower Moving & Storage for property located on the 14 north side of Metzger Road, approximately 600 feet west of 39th Street in the IL 15 (Industrial, Light) Zoning District consisting of: 16 17 . Three existing buildings containing 37,703 square feet; plus 18 . two warehouses of 8,750 square feet; 19 . 1,950 square feet of office; 20 . two buildings of 4,800 and 4,700 square feet for mini-storage units; and 21 . 4,900 square feet of covered loading dock. 22 23 The total square footage of the project is 71,553 square feet. 24 25 2. The Development Review Committee has reviewed the site plan for the proposed 26 project and found it to meet all technical requirements and to be consistent with the 27 future land use maps of the St. Lucie County Comprehensive Plan. 28 29 3. The proposed project is consistent with the general purpose, goals, objectives and 30 standards of the St. Lucie County Land Development Code, the St. Lucie County 31 Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 32 33 4. The proposed project will not have an undue adverse effect on adjacent property, the 34 character of the neighborhood, traffic conditions, parking, utility facilities or other 35 matters affecting the public health, safety and general welfare. 36 37 5. All reasonable steps have been taken to minimize any adverse effect of the proposed 38 project on the immediate vicinity through building design, site design, landscaping and 39 screening. 40 41 6. The proposed project will be constructed, arranged and operated so as not to interfere 42 with the development and use of neighboring property, in accordance with applicable 43 district regulations. 44 45 7. The proposed project will be served by well and septic which are adequate for the use. 46 47 8. The applicant has applied for and received a certificate of capacity, a copy of which is 48 attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Page 1 October 24,2006 EDWIN M. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.05(B) of the St. Lucie County Land Development Code, the Major Site Plan to be known as Treasure Coast Mayflower Moving & Storage, is hereby, approved as shown on the site plan drawings for the project prepared by The Velcon Group on March 10, 2006, last revised on September 20, 2006 and date stamped received by the St. Lucie County Growth Management Department on September 28, 2006, subject to the following conditions: 1. No development permits shall be issued until complete sets of sealed constructible final engineering plans, supporting calculations and survey data for the site work and offsite improvements are approved by the Office of the County Engineer, Public Works Department, Utilities Department, Environmental Resources Department, Growth Management Department, Fire Department, and any other agency that may be determined by the Director of Growth Management to be necessarily involved in the review and approval of the constructible final engineering plans for the site work and offsite improvements. The determination of whether or not plans submitted by the applicant constitute a complete set of constructible plans shall be made by the departments involved in the plan review within five business days of the date the plans are received in the Department of Growth Management. 2. Prior to the issuance of any building permit the developer, his successor or assigns, shall either construct or provide sufficient security in accordance with Section 11.04.00 of the St. Lucie County Land Development Code for the construction of a 6-foot wide sidewalk along the project's frontage on Metzger Road. 3. Prior the issuance of any Land Clearing Permits for the Treasure Coast Mayflower Moving & Storage Site, the developers, or his assigns, shall clearly delineate all trees to be preserved and/or protected. Delineation shall be by either the placing of silt fencing, safety fencing or similar type of materials. Flagging shall not be used except to guide the installation of the fencing materials. All land clearing activities shall be in accordance to the specific conditions/standards outlined in the Land Clearing Permit. Upon installation, the Environmental Resource Division prior to issuance of the land- clearing permit shall inspect the installed fencing. 4. The applicant shall be required to provide all side and rear yard perimeter buffer areas between non-residential and single family or two family residential uses shall be landscaped with a masonry wall or opaque wood fence of at least eight (8) feet in height that forms a continuous screen between the uses. All masonry walls or opaque wood fences shall be landscaped with a continuous hedge along both the inside and outside base of the wall or fence. One tree shall be planted Page 2 October 24, 2006 Resolution No. 06-237 Files No.: MJSP 05-023 1 along the wall or fence for each thirty (30) linear feet or major fraction thereof of 2 the length of the wall or fence. Tree plantings shall be alternated so that at least 3 60% of the required number of trees is located on the outside of the wall or 4 fence. The remaining 40% of the required perimeter tree plantings shall be 5 located on the inside face of the wall or fence. 6 7 8 9 10 B. The Major Site Plan approval granted under this Resolution is specifically conditioned to 2 the requirement that the petitioner, Mark Stromak. including any successors in interest, 3 shall obtain all necessary development permits and construction authorizations from the 4 appropriate State and Federal regulatory authorities, including but not limited to; the 5 United Stated Army Corp of Engineers, the Florida Department of Environmental 6 Protection, and the South Florida Water Management District, prior to the issuance of 7 any local building permits of authorizations to commence development activities on the 8 property described in Part B. 9 10 D. A Certificate of Capacity, a copy of which is attached to this Resolution as Exhibit A, was 11 granted by the Director of Growth Management on October 2, 2006, which certificate 12 shall remain valid for the period of Site Plan approval or any extension grated thereto. If 13 this order expires or otherwise terminates, the Certificate of Capacity shall automatically 14 terminate. 15 16 E. The St. Lucie County Director of Growth Management is hereby authorized and directed 17 to cause the notation of this resolution to be made on the Official Zoning Map of St. 18 Lucie County. Florida, and to make notation of reference to the date of adoption of this 19 resolution. 20 21 F. The Director of Growth Management shall coordinate the issuance of further site 22 Development Permits. No final site construction authorizations or site Development 23 Permits shall be issued until all requirements for such permits are met. 24 25 26 G. This resolution shall be recorded in the Public Records of St. Lucie County. The 27 recording of this resolution does not authorize commencement of anyon-site 28 development activities without obtaining such further development permits as may be 29 required. All applicable conditions of approval as set forth above, and applicable code 30 requirements must be met to satisfaction of the County before final site construction 31 permits are issued. 32 33 H. A copy of this Order shall be attached to the site plan drawings described in Part A, 34 which plan shall be placed on file with the St. Lucie County Growth Management 35 Director and mailed, return receipt requested to the developer and agent of record as 36 identified on the site plan applications. 37 38 I. The conditions set forth in Part A are an integral nonseverable part of the Major Site 39 40 J. Plan approval granted by this Resolution. If any condition set forth in Part A is 41 determined to be invalid or unenforceable for any reason and the developer declines to 42 comply voluntarily with that condition, the site plan approval granted by this resolution 43 shall become null and void. 44 45 K. This Major Site Development Plan approval shall expire on October 24, 2008, unless an 46 extension is granted in accordance with Section 11.02.06(B)(3), St. Lucie County Land 47 Development Code or unless a building permit is secured. 48 49 L. The effective date of this resolution shall be the date of adoption contained herein.
