Mavo Development Group LLC. presented a petition for a Major Site Plan Project, to be known as Mayo Warehouses, to provide for the construction of 38,999 square feet of industrial flex space within the first phase of a two phase project within the Midway Road Industrial Park, Phase II, located on the northwest corner of West Midway Road and South Jenkins Road, in the IH (Industrial, High) Zoning Districtfor the property as described below in Section B. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet all technical requirements and to be consistent with the future land use maps of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part A of this Resolution. 3. The proposed project is consistent with the general purpose, goals, objectives and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan and the Code of Ordinances of St. Lucie County. 4. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 6. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the Major Site Plan to be known as Mayo Warehouses, is hereby approved as depicted on the site plan drawings for the project prepared by Arcweks Incorporated, dated 12/17/04, last revised on 6/06/06, and date stamped received by the St. Lucie County Growth Management Director on 6/19/06, for the property described in Section B, subject to the following conditions. 1. Prior to the issuance of any permits, a Final Development Order shall be obtained from the Director of Growth Management, or designee. Prior to the issuance of said Development Order, the Director of Growth Management shall determine that all conditions of approval and applicable code requirements are satisfied and shall: a. Obtain comments from the appropriate county staff, legal staff, and other responsible agencies regarding the satisfaction of all applicable code requirements and conditions of approval. b. Confer with the County Engineer, Public Works Department, Environmental Resources Department, and Utilities Department to determine the number of constructible engineering plans that shall be required to be submitted for review, and the applicant shall, following notification by the Director of Growth Management, submit the required number of plans to the Department of Growth Management for processing, distribution, and final action. c. Require that a complete set of sealed constructible final engineering plans, supporting calculations and survey data for the site work and offsite improvements are approved by the Office of the County Engineer, Public Works Department, Utilities Department, Environmental Resources Department, Growth Management Department, Fire Department, and any other agency that may be determined by the Director of Growth Management to be necessarily involved in the review and approval of the constructible final engineering plans for the site work and offsite improvements. The determination of whether or not plans submitted by the applicant constitute a complete set of constructible plans shall be made by the departments involved in the plan review within five business days of the date the plans are received in the Department of Growth Management. 2. Prior to issuance of construction permits the developer, successors or assigns shall provide for five foot bike lanes along this project's West Midway Road and South Jenkins Road frontage. The applicant may provide funds equal to the estimated total cost of the bike lanes, as determined and approved by the County Engineer. 3. The developer, successor, or assigns, shall be required to construct a right turn lane at File No.: MJSP-04-011 October 24, 2006 Resolution No. 06-226 Page 2 · ' 1 the projects West Midway Road entrance. 2 3 4. Prior to the issuance of a building permit, the developer, or his assigns, shall provide an 4 executed copy of a final utility service agreement with Ft. Pierce Utility Authority, 5 indicating all developer obligations, including schedules associated with servicing this 6 site. 7 8 5. The irrigation system within this project shall be designed to accept reuse water from the 9 Fort Pierce Utilities Authority, or other duly recognized utility authority or district, as the 10 preferred method of irrigation. 11 12 6. Prior to the issuance of buildings permits elevations and drawings shall be provided that 13 demonstrate the project will comply with the signage and building design requirements of 14 the St. Lucie County Architectural Standards set forth in Section 7.10.23 of the St. Lucie 15 County Land Development Code. 16 17 7. The irrigation system within this project shall be designed to accept reuse waterfrom the 18 Fort Pierce Utilities Authority, or other duly recognized utility authority or district, as the 19 preferred method of irrigation. 20 21 8. The landscape plan graphic shows five Gumbo Limbo symbols but the plant legend lists 22 three. A condition of approval of the site plan shall be that at the time of landscape 23 inspection (as part of the certificate of occupancy approval) there shall be 5 Gumbo 24 Limbo's planted as shown on the landscape plan graphic. 25 26 9. The landscape plan graphic shows eleven Laurel Oak symbols but the plant legend lists 27 nine. A condition of approval of the site plan shall be that at the time of landscape 28 inspection (as part of the certificate of occupancy approval) there shall be 11 Laurel Oaks 29 planted as shown on the landscape plan graphic. 30 31 10. Since 10 Cabbage Palms fall within the limits of clearing (shown on the land clearing 32 plan, sheet 9 of 12), the required mitigation will be the relocation of the 10 Cabbage 33 Palms or the planting of 20 Cabbage Palms (in addition to the 6 shown on the landscape 34 plan as they are credited towards required landscaping). 35 36 11. Since 2 Slash Pines (a 12" and a 15") fall within the limits of clearing (shown on the land 37 clearing plan, sheet 9 of 12), the required mitigation will be the planting of 54" of Slash 38 Pine on site or donation of 54" of slash pine to St. Lucie County (in addition to the 39 minimum landscape requirements). 40 41 12. No vegetation shall be impacted in Lot 1 in association with this site plan until the future 42 phases (which incorporate Lot 1) are approved. 43 44 13. The resolution shall be recorded in order to provide constructive legal notice of 45 development conditions that run with the land. All conditions of approval and applicable code requirements 2 must be determined to be satisfied by the Director of Growth Management. 3 4 14. Within 45 days of the approval of this resolution, the developer/applicant, Mayo 5 Development Group, LLC and St. Lucie County shall meet to review the options 6 associated with the developer, his successors or assigns, accepting all or part of the 7 stormwater run-off from the planned improvements to West Midway Road (Turnpike to 8 South 25th Street) within the immediate area of the property described in Part B below. If 9 at the end of the 45 day period a consensus cannot be reached as to the feasibility to 10 accommodate St. Lucie County's request for this review, then the review of these options 11 shall cease and the Mayo Warehouses project, as described in this Resolution, shall be 12 permitted to move forward for local construction permitting approvals consistent with the 13 other provisions of this Resolution. If at the end of the 45 day period, a consensus is 14 reached that it is feasible to accept, or route, the anticipated stormwater run-off from the 15 planned improvements to West Midway Road (Turnpike to South 25th Street) within the 16 immediate area of the property described in Part B below into or through the property, the 17 County and the developer, his successors or assigns, shall immediately seek an 18 agreement outlining the; timing, design parameters, party obligations and compensation 19 considerations for the provision of this stormwater treatmenUconveyance area. 20 Compensation considerations may include, but not be limited to, impact fee credits, 21 mitigation credits, and direct financial restitution or as may otherwise be agreed to by the 22 Board of County Commissioners and Mayo Development Group, LLC. Nothing in this 23 condition shall bind or obligate either the County or Mayo Development Group, LLC into 24 accepting an agreement or other action that is not mutually acceptable to all parties. 25 26 27 28 29 B. The property on which this Major Site Plan approval is being granted is described as follows: 30 31 Being all of Lot 1 & Lot 2, according to the Plat of Midway Industrial 32 Park - Phase II, as recorded in Plat Book 39, Page 8 & 8A, Public 33 Records of St. Lucie County, Florida, less and excepting that parcel 34 described in O.R. Book 1324, Page 917 of the Public Records of St. 35 Lucie County, Florida for additional right-of-way for West Midway 36 Road. 37 38 (Tax ID#: 3406-601-0002-0004) 39 40 (Location: Northwest side of the intersection of West Midway Road 41 and South Jenkins Road) 42 43 C. The approvals and authorizations granted by this Resolution are for the purpose of obtaining 44 building permits on this property, shall expire on October 17, 2008, unless the developer has 45 obtained building permits for the site plan described in Part A or an extension has been 46 granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. 47 File No.: MJSP-04-011 October 24, 2006 Resolution No. 06-226 Page 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 D. The Major Site Plan approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, Mayo Development Group, LLC, including any successors in interest, shall obtain all necessary development permits and construction authorizations form the appropriate State and Federal regulatory authorities, including but not limited to: the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. E. The Certificate of Capacity, a copy of which is attached to this resolution, shall remain valid for the period of Site Plan approval. Should the Site Plan approval granted by this resolution expire or an extension be sought pursuant to Section 11.07.05(F) of the St. Lucie County Land Development Code, a new certificate of capacity shall be required. F. A copy of this resolution shall be attached to the site plan drawings described in Section A, which plan shall be placed on file with the St. Lucie County Growth Management Director. G. The St. Lucie County Growth Management Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of St. Lucie County, Florida, and to make notation of reference to the date of adoption of this resolution. H. The Director of Growth Management shall coordinate the issuance of further site Development Permits. No final site construction authorizations or site Development Permits shall be issued until all requirements for such permits are met. I. A copy of this resolution shall be mailed, return receipt requested to the developer and agent of record. This resolution shall be recorded in the Public Records of St. Lucie County. The recording of this resolution does not authorize the commencement of anyon-site development activities without obtaining such further development permits as may be required. All applicable conditions of approval as set forth above, and all applicable code requirements must be met to satisfaction of the County before final site construction permits are issued.
