HomeMy WebLinkAbout04-325 RESOLUTION NO. 04-325 File No.: CU-03-017 AN 0 MJSP-03-017 A RESOLUTION DENYING A MAJOR SITE PLAN AND A CONDITIONAL USE PERMIT FOR A SAND MINING OPERATION IN THE AG-5 (AGRICULTURE 1 DU5/ACRE) ZONING DISTRICT FOR PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA, TO BE KNOWN AS ST. LUCIE CITRUS MINE WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence presented during a public hearing held on October 19, 2004, including but not limited to the staff report, has made the following determinations: CONDITIONAL USE PERMIT 1. Carl Austin Powers, presented a petition for a Conditional Use Permit for the operation of a Sand Mining Operation, to be known as St. Lucie Citrus Mine, in the AG-5 (Agricultural - 1 du/5 acre) Zoning District for the property described in Part B. 2. On March 18,2004, the St. Lucie County Planning and Zoning Commission held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners deny the hereinafter described request for a Conditional Use Permit in AG-5 (Agricultural - 1 du/5 acre) Zoning District for the property described in Part B. 3. On October 19, 2004, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property. 4. The proposed Conditional Use is near or adjacent to existing and proposed residential developments (Aero Acres to the south, the proposed Carlton County Estates to the north and Hidden Acres to the northeast). 5. The proposed Conditional Use has been determined not to be consistent with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan. 6. The proposed Conditional Use will have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, noise, water tables, dust or other matters affecting the public health, safety and general welfare. The proposed Cond itionaJ Use is not compatible with the residential character of the surrounding area and would be inconsistent with the surrounding neighborhoods, specifically the impacts from the proposed sand mining operation, including noise, traffic conditions, repetitive noises, dust and air contaminants would negatively impact the single family residential neighborhoods. SITE PLAN 8. Carl Austin Powers presented a petition for a Major Site Plan approval to operate a sand mining operation, to be known as St. Lucie Citrus Mine; in the AG-5 (Agricultural - 1 du/5 acre) Zoning District for the property described in Part B. 9. The required Conditional Use Permit associated with this Major Site Plan has been determined not to be consistent with the goals, objectives, and policies of the St. Lucie County Comprehensive PJan~ 10. The proposed project is not compatible with the residential character of the surrounding area and would be inconsistent with the surrounding neighborhood. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: CONDITIONAL USE PERMIT A. Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, a Conditional Use Permit for Carl Austin Powers to provide forthe operation of a sand mining operation to be known as St. Lucie Citrus Mine, in AG-5 (Agricultural- 1 du/5 acre) Zoning and as depicted on the site pran drawings described in Part 0, is hereby denied for the property described in Part B. B~ The property on which this Conditional Use Permit is being denied is described as follows: Legal Description: THE NORTHWEST QUARTER OF SECTION 14, TOWNSHIP 36 SOUTH, RANGE 38 EAST, LESS AND ACCEPT THE NORTH 50.5, THE WEST 50 FEET, AND THE SOUTH 47 FEET. SAID PARCEL CONTAINS 152.69 ACRES, MORE OR LESS. SITE PLAN c.
