LUCIE COUNTY, FLORIDA WHEREAS, the Board of Adjustment of SI. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: 1. Oscar P. Frozini and Fernando Velasco. presented a petition for a Variance from the Provisions of Section 7.04.01 (A), of the SI. Lucie County Land Development Code, to permit the development of property into three single-family lots, which would each lack a maximum of 4.51 feet of the minimum 150 foot lot width required in the AG-2.5 (Agricultural - 1 du/2.5 acres) Zoning District for the property depicted on the attached maps as Exhibit "A" and described below. 2. On August 23, 2006, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property. 3. After consideration of the testimony presented during the public hearing, including staff comments and the standards of review for granting variances set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made the following determination: The requested variance has met the standards of review as set forth in Section 10.01.02, Sf. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the Sf. Lucie County Comprehensive Plan, because: 1. The variance granted is the minimum variance that will make possible the reasonable use of the land, structure, or building. 2. The variance granted will not have adverse impacts to other property or improvements in the neighborhood. 3. The variance granted meets the general spirit and intent of the Sf. Lucie County Land Development Code and the Sf. Lucie County Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of SI. Lucie County, Florida and the East right of way line of Gentile Road (formerly Lochrie Road) as set forth in Deed Book 95, page 111, ofthe Public Records of SI. Lucie, County, Florida; thence run North along said East right of way line, a distance of 637 feet to the Point of Beginning of the tract herein described; from said Point of Beginning continue North along said East right of way line 436.5 feet; thence East 567.0 feet; south 436.5 feet; thence West 567.0 feet to the Point of Beginning. Parcel 2: A parcel of land located in the Southeast Quarter of Section 22, Township 35 South, Range 39 East, SI. Lucie County, Florida, being more particularly described as follows: Commence at the intersection of the South line of the North 'I. of the Southeast Quarter of said Section 22 and the East right of way line of Gentile Road (formerly Lochrie Road) as set forth In Deed Book 95, Page 111, of the Public Records of SI. Lucie County, Florida; thence run North 00 Degrees 21'15" East along said East right of way line 1073.50 feet; thence North 89 Degrees 14'55" East parallel to the South line of said North 'I. of the Southeast Quarter 567.00 feet to the Point Of Beginning of the land herein described; from said Point Of Beginning continue North 89 Degrees 14'55" East 333.17 feet to a line that lies 900.00 feet East of measured at right angles to the East right of way line of said Gentile Road (formerly Lochrie Road); thence South 00 Degrees 21' 15" West parallel to said East right of way line 483.51 feet; thence South 89 Degrees 14'55" West parallel to the South line of said North 'I. of the Southeast Quarter 609.77 feet; thence North 00 Degrees 21'15" East parallel to the East right of way line of said Gentile Road (formerly Lochrie Road) 47.30 feet; thence North 89 Degrees 14'55" East parallel to the South line of the North % ofthe Southeast Quarter 276.60 feet; thence North 00 Degrees 21'15" East parallel to the East right of said Gentile Road (formerly Lochrie Road) 436.50 feet to the Point Of Beginning. LESS And EXCEPTING therefrom the South 47.30 feet thereof. (Tax ID#: 2322-413-0004-000/1) (Location: East side of Gentile Road approximately 1,500 feet north of Okeechobee Road) This variance shall expire twelve months from the date of adoption unless a final site plan is approved or an extension is granted in accordance with Section 10.01.06, of the SI. Lucie County Land Development Code.
