LUCIE COUNTY, FLORIDA WHEREAS, the Board of Adjustment of SI. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: 1. Michael J. Cannon. presented a petition for a Variance from the Provisions of Section 7.04.01(A), ofthe SI. Lucie County Land Development Code, to permitthe construction of two single-family residences on two lots, which would each have a deficit of a maximum of 160 square feet of the minimum 10,000 square teet required in the RS-4 (Residential, Single Family - 4 du/ac) Zoning District for the property depicted on the attached maps as Exhibit "A" and described below. 2. On June 28, 2006, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet ot the subject property and continued this item to July 26, 2006. 3. On July 26, 2006, this Board held a public hearing on the petition. 3. After consideration of the testimony presented during the July 26, 2006, public hearing, including staff comments and the standards of review tor granting variances set out in Section 10.01.02, SI. Lucie County Land Development Code, the Board of Adjustment has made the following determination: The requested variance has met the standards of review as set forth in Section 10.01.02, SI. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because: 1. The variance granted is the minimum variance that will make possible the reasonable use of the land, structure, or building. 2. The variance granted will not have adverse impacts to other property or improvements in the neighborhood. 3. The variance granted meets the general spirit and intent of the SI. Lucie County Land Development Code and the SI. Lucie County Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of SI. Lucie County, Florida: A. Michael J. Cannon, presented a petition for a Variance from the Provisions of Section 7.04.01 (A), of the SI. Said condition shall be required to be included in the contract for sale on the subject property. B. The property on which this Variance approval is granted is described as follows: LAKEWOOD PARK UNIT 10 BLOCK 123 LOT 9 AND 10 (Tax ID#: 1301-612-4119-(0013) (Location: North side of Salerno Road, approximately 325 feet west of De Leon Avenue in the Lakewood Park Subdivision) C. This variance shall expire twelve months from the date of adoption unless a building permit is approved or an extension is granted in accordance with Section 10.01.06, of the SI. Lucie County Land Development Code.
