WHEREAS, the SI. Lucie County Growth Management Director has reviewed the application for a minor site plan approval submitted by Michael and Roberta West, reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: Howard's Twenty is a proposed two lot subdivision, on property located on the west side of Sneed Road, in the AG-5 (Agriculture, 1 du/5 ac) Zoning District. 1. The Development Review Committee has reviewed the minor site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be consistent with the SI. Lucie County Comprehensive Plan. 2. The project is consistent with the general purpose, goals, objectives, and standards of the SI. Lucie County Comprehensive Plan and the SI. Lucie County Land Development Code. 3. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 4. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 5. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 6. The project is to be served by adequate public facilities and services. 7. The applicant has applied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, SI. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed Minor Site Plan to be known as Howard's Twenty, is hereby approved as shown on the site plan drawings for the project prepared by The Vel con Group, dated July 26. 2006, and received by the St. Lucie County Growth Management Director on October 16, 2006, for the property described below, subject to the following conditions: File No.: MNSP 06-022 GM -06-034 November 28, 2006 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 C. 1. The applicant must provide an Environmental Impact report to the Environmental Resources Department if the requirement for the report is not waived by the Board of County Commissioners prior to approval of a St. Lucie County Notice of Vegetation Removal. 2. A ten foot right-of-way dedication is required as a condition of Final Plat approval. 3. All required survey markers shall be set before the plat is recorded. 4. Prior to Final Plat approval, all monuments, found or placed, must be described on the survey map. The corner descriptions shall state the size, material, and cap identification of the monument as well as whether the monument was found or set or numbered or unnumbered. B. BOOK 27, PAGE 398, OF THE PUBLIC RECORDS OF ST. lUCIE COUNTY, FLORIDA. The Final Site Plan approval granted under this Resolution is specifically conditioned to the requirement that the petitioners, Michael and Roberta West, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. E. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. F. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. G. This order shall be recorded in the Public Records of SI. Lucie County.
