AN ORDER AMENDING CONDITION #2 AND
CONDITION #5 CITED WITHIN GM-06-022,
ADOPTED ON JULY 18,2006, FOR MINOR SITE
PLAN APPROVAL FOR THE PROJECT TO BE
KNOWN AS VINCENT DISISTO TRUST
WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for site
plan approval submitted by Richard Ahrens, reviewed the comments of the St. Lucie County
Development Review Committee on this application, and made the following determinations:
1. On July 18, 2006 the Growth Management Director granted approval of 15,440 square foot
light industrial building through Growth Management Order 06-022 for Petitioner Vincent
Disisto Trust.
2. Following the recordation of Growth Management Order 06-022, staff determined that
Condition #2 cited within that order contained an error.
3. Following the recordation of Growth Management Order 06-022, staff determined that
Condition #5 cited within that order contained an error.
NOW, THEREFORE, BE IT ORDERED:
A. Condition #2 cited within the order should have read as follows:
2. Pursuant to Section 11.02.08(A)(6) of the St. Lucie County Land Development Code,
no work shall commence on the site until all regulatory permits required from
Federal, State, and regional agencies and special districts have been issued. The
developer shall submit to the County Engineer or his designee evidence of
compliance with the Florida Department of Environmental Protection National
Pollutant Discharge and Elimination System prior to construction. All National
Pollutant Discharge and Elimination System Best Management Practices shall be
instituted on the site prior to site clearing and maintained daily.
B. Condition #5 cited within the order should have read as follows:
5. The developer, his successors or assigns shall construct a 5-foot sidewalk along the
project's frontage on Commercial Circle or the developer, his successors or assigns
shall petition the Board of County Commissioners for total or partial relief from the
requirements of the sidewalk construction if it finds, after receiving the
recommendation of the Development Review Committee and based on conditions
peculiar to the proposed development, that the proposed sidewalk construction is not
in the best interest of SI. Lucie County, the applicant shall pay a fee-in-lieu to the

County for sidewalk construction. The fee-In-lieu shall be based an engineer's
estimate and approved by the County Engineer.
C. All the terms, findings, and conditions otherwise cited in Growth Management Order 06-
022, approved on July 18, 2006, are hereby incorporated by reference in Growth
Management Order 06-022.
D. This Development Order shall be recorded in the Public Records of SI. Lucie County,
Florida, in order to provide constructive legal notice of development conditions that run with
the land.
E. The Code Compliance Manager shall receive a copy of this Development Order and the
site plan it approves and shall not approve any building permits that do not implement or
are not consistent with this Development Order and the plans hereby approved.
ORDER effective the 16th Day of November 2006.
